The center provides free chat and legal support to workers in Eumseong.

It might be easy to find such a center in a big city.

However, it is surprising that such a center exists in Eumseong-gun, which has a population of about 100,000.




More than half of the residents of Eumseong County are living as workers.

Who do they turn to when they are treated unfairly at work?

Of course, there are local labor offices that have jurisdiction over them.

However, it is difficult for workers here to prepare the relevant documents and visit the local labor office.

The Eumseong Labor Human Rights Center exists for these workers.


Non-profit organization 'Voice Labor Human Rights Center'


The Eumseong Labor Human Rights Center was established in 2015.

It is a non-profit organization.

Office operating expenses and the activity expenses of full-time activists are covered by donations from citizens.

Activists offer free consultations for workers.

The contents of counseling are diverse, such as dismissal, non-payment of wages, industrial accidents, and workplace harassment.


Harassment complaints from restaurant cooks...

Human Rights Center with 2 years


In 2019, workers visited the Human Rights Center.

This is worker A who works as a cook at a restaurant in a hospital in Eumseong, North Chungcheong Province.

Mr. A asked for help, saying that he was forced to pay for a dinner party, forced to sell cosmetics, and even heard abusive language and sexual harassment remarks from a superior.



Mr. A almost ran away from the company.

From then on, I received help from the Eumseong County Labor Human Rights Center.

The Human Rights Center first helped in reporting workplace harassment.

Also, the company applied for relief to the Chungbuk Labor Relations Commission for changing Mr. A's work place, and it was recognized as an unfair telegram.



Mr. A's mental stress intensified in the process of confrontation with the company.

Because of this, I was even admitted to the emergency room.

In every crisis, the Eumseong Labor Human Rights Center helped.

Activist Park Yoon-jun, the head of the counseling office here, also went to the hospital and stayed by the side when Mr. A went to work after reporting harassment.



A miracle that happened in Eumseong-gun...

First prison sentence for violating the 'Workplace Harassment Prohibition Act'

The Human Rights Center next helped Mr. A to file a complaint with the local labor office against the employer under Article 76-36 of the Labor Standards Act.

The Workplace Harassment Prohibition Act, that is, Article 76-3 of the Labor Standards Act, prohibits employers (employers) from treating a person who reported harassment unfavorably.

In particular, paragraph 6 is the only criminal punishment possible in accordance with Article 109 (penalty provisions) of the Labor Standards Act.

The Human Rights Center found that Mr. A violated paragraph 6 on the basis that he took unfair telegram measures after reporting harassment.


6 months in prison, 2 years probation

The prosecution took over the case and requested a summary order of 2 million won in fine (old form).

The Human Rights Center also thought that the court would issue an abbreviated order of 2 million won in fine and end.

However, the defendant, the owner, requested a formal trial saying that he could not pay 2 million won.



This is how the official trial was opened.

In April, the first trial was sentenced at the Chungju Branch of the Cheongju District Court.

He was sentenced to six months in prison, two years of probation, and 120 hours of community service.

Rather, harsher punishments were imposed.



The judgment read, "If you look at the individual actions taken by the accused company in a series of steps from the time the victim went to the head office and complained about damage to the management director until the unfair transfer relief trial was finalized, no consideration for workers could be found. ."

It says.

Accordingly, the defendant's low level of awareness among workers was judged to be neglected at any time when another victim occurred, and thus he was sentenced to imprisonment.



Two years from the enforcement of the 'Workplace Harassment Prohibition Act'...

What is Restorative Justice?

This first trial sentence is the first case of imprisonment in the workplace after workplace harassment was implemented in July 2019. This is a new history that took place in Eumseong, North Chungcheong Province. In some ways, it was impossible for Mr. A to do it alone. This is a big change made with the help of the Eumseong Labor Human Rights Center.



It is certainly a meaningful change for an employer to be sentenced to imprisonment for violating the Workplace Harassment Prevention Act. What other changes do we need to achieve then? There is a word for 'restorative justice' or 'restorative justice'. It is a judicial theory that focuses on the recovery of victims rather than on punishing perpetrators.



A large number of victims of workplace harassment are secondary perpetrators. This is because there are issues of retaliation and bullying by the company after reporting. Because of this, victims often regret reporting it. While it is important to properly punish perpetrators, it is time for all of us to think about helping victims return to work and lead a normal life.
