A 40-year-old man in his 40s who drove tens of kilometers while holding his 6-month-old son intoxicated was sentenced to a heavier punishment than the original trial court.

The Chuncheon District Court's Criminal Division 1 (Chief Judge Kim Cheong-mi) broke the original sentence of a fine of 7 million won to 49-year-old A, who was charged with drunk driving and obstruction of public service under the Road Traffic Act, and sentenced him to one year in prison and two years of probation It was announced yesterday (13th).

Mr. A was handed over to trial on the charge of driving under the influence of about 40 km from Chuncheon to Hwacheon on May 13, 2020 at 9:50 am.

A, who

had a blood alcohol concentration of 0.115% at the time

, which was at the level of revocation of

his

license, drove with his son, who was only six months old, in his arms.

In June of the same year, Mr. A was

also

accused of swearing and assaulting a police officer who was dispatched after receiving a report of assault from his wife

.

The court of appeals said, "At the time of the crime, the blood alcohol level was high, the driving distance reached 40 km, and the risk of an accident was serious, such as drunk driving while holding a baby."

He also judged, "The degree of tangible force is not lightly used for the offense of obstructing the execution of official duties, and there is a history of being

punished, including imprisonment, several times for the same or different kinds of crimes

."

The court explained the reason for the sentencing, saying, "Since the crime cannot be stopped, the possibility of accusation is high and the risk of re-offending is high, so the sentence of the lower court is judged to be rather light."
