Rep. Hwang Unha of the Democratic Party, who was elected as a member of the National Assembly while maintaining the police status, and controversial controversy over the election, has won the election invalidation lawsuit and has retained the position of parliament. The former United Progressive Party lawmakers failed to recover their positions.

Hwang Unha, a member of the Democratic Party, applied for honorary retirement in November 2019, who was the head of the Daejeon Provincial Police Agency, but the National Police Agency did not accept it.



This was the reason that the prosecution was being investigated for the Ulsan mayoral election intervention case.



Rep. Hwang reapplied for dismissal in January of last year, and was elected in the general election after going through the admission process.



The police imposed conditional dismissal in May of last year, the day before the start of Hwang's tenure.



As a result, Lee Eun-kwon, a former member of the Future Integration Party, filed a lawsuit against Hwang, and the Supreme Court ruled against Lee's claim today (29th).



The judiciary decided that if the employee was submitted, it could be considered that he had quit his job at the time of receipt, regardless of whether it was accepted or not.



He added that it fits the purpose of the legislative party system democracy to see that if a party is allowed to join a party if he or she expresses his intention to resign.



Since the lawsuit for invalidation of the election is a single trial system, today's ruling left Rep. Hwang to remain a member of the National Assembly.



On the other hand, the former members of the Unified Progressive Party, who lost their positions as members of the Constitutional Court in December 2014, when the party was disbanded, could not regain their positions.



Section 3 of the Supreme Court did not accept plaintiffs' claims in lawsuits for confirming the status of members of the National Assembly against the state by former Tongjin Party lawmakers.



The court judged that it was in line with the democratic ideology to exclude members of the party who were decided to dissolve the party.
