A person in her 40s, who was handed over to trial for committing obscene acts on a highway bus, was sentenced to the same imprisonment as the first trial at the appeal trial.

The second criminal division of the Gwangju District Court (Judge Kim Jin-man) announced today (19th) that it dismissed the appeal of 48-year-old A, who was sentenced to nine months in prison at the first trial after being charged with performing lewdness.

On September 26, 2020, Mr. A was accused of committing obscene acts while exposing important parts on a highway bus in a region in Jeollanam-do for 15 minutes from 1:30 pm.

At the time, it was revealed that Mr. A was committing a crime while looking at a female teenager sitting diagonally in front of him, turning obliquely toward the corridor of the bus.

Mr. A

insisted on a weakness in mind and body

at the

appeal trial,

but the judge decided that "at the time of the crime, it is not admitted that he was in a state of poor ability to discriminate objects or make decisions."

The court

did not accept Mr. A's claim of unjust sentencing, saying, "Mr. A has a

history of being punished for a sexual crime several times, and he committed a second offense during a sexual crime.

Also, the victim seems to have suffered a significant trauma."

The court also maintained an order to limit employment to children and youth-related institutions and welfare facilities for the disabled for three years, as well as the completion of the 40-hour sexual violence treatment program issued by the lower court to Mr. A.
