After giving birth in a toilet bowl, the court sentenced the mother to a probation from imprisonment, saying, "The person who will suffer the most is the defendant himself."

In December 2018, a 28-year-old woman, A, was in a relationship with a 22-year-old man B, whom she met through a smartphone app, and confirmed that she was pregnant in March of the following year.

A later bought and took abortion pills through an illegal site, and in May of the same year, when she was about 23 weeks pregnant, she gave birth to a girl on the toilet at her home.

Immediately after delivery, Mr. A left the child in cold water to let him die, and then abandoned the body with Mr. B in the mountains of Gyeonggi Province.

In the process, the two even tried to burn the bodies, prosecutors said.

The first trial sentenced Mr. A to 5 years in prison on charges of infanticide and abandonment of the corpse, and to Mr. B for abandonment of mortality, and sentenced him to 3 years in prison.

However, both of them appealed, saying, "The sentence is too heavy," and in the process, they submitted 32 statements of reflection.

The Daejeon District Court Criminal Affairs Division 1 (deputy judge Yoon Seong-mook) sentenced Mr. A to two years in prison, three years probation, and to Mr. B one year in prison and two years probation.

The judge said, "Even though A heard a cry right after birth, he left the victim to die of hypoxia and hypothermia caused by breathing difficulties." I think the child could have lived."

Still, "Mr. A committed the crime in a state of extreme excitement immediately after delivery, with shame and fear of accusations from his family," he said.

He added, "It seems that this case will remain a big scar for the defendants, in a situation where the two who are repenting for the wrong are currently believed to be the most suffering people."
