He tried to avoid punishment by agreeing with his girlfriend that he would marry, but eventually paid the penalty.



According to the legal community, Judge Shin Soon-young, who was solely responsible for the 7th criminal law of the Northern District of Seoul, recently sentenced Mr. A (28), who was charged with special injuries, to one year in prison.



Mr. A was handed over to trial on September 19, 2017 on charges of dropping the victim by abruptly breaking the steering wheel while driving about 100m with his girlfriend B hanging on the bonnet of a car in a parking lot in Nowon-gu, Seoul.



At the time, Mr. A got into the car after arguing with his girlfriend, and when Mr. B got on the bonnet of the car to chase after Mr. A, he moved the steering wheel left and right to drop it.



Eventually, Mr. B fell out of the car and broke his nose bone.



A month later, on October 28, 2017, when Mr. B came to ask for 12.5 million won, which he spent to treat his nose, Mr. A assaulted Mr. B, breaking his collarbone and injuring his face.



Still, Mr. A was not punished.



This is because the victim filed an application for disapproval to the police, saying, "There is no benefit to punishment because you are going to marry in the future."



The police ended both cases of assaults committed by Mr. A with non-prosecution.



However, when Mr. B submitted a petition to the prosecution in November of the same year to punish Mr. A's assault, the investigation took place again.



In his affidavit, he wrote, "I believed Mr. A's promise to marry and filed an application for punishment, but he did not keep the promise. The first statement to the police was false."



The court judged that "the victim was not able to organize his feelings as a lover with the defendant and tried to maintain the relationship by letting the defendant be elected," and "considering the fact that the victim paid the treatment fee, the victim's statement is reliable." .



He added, "The victim's injuries are not light and the accused is in a hurry to deny the crime, so the sentence is decided in consideration of the attitude of refusing to reflect."
