President Moon Jae-in's son, Moon Joon-yong, filed a lawsuit against the prosecution and won the first trial, asking to disclose the investigation data of the case related to the suspicion that he was hired with preferential treatment.



The 14th Administrative Division of the Seoul Administrative Court (Deputy Judge Sang-Hoon Lee) recently ruled that some of the plaintiffs won a lawsuit against the Seoul Southern District Prosecutor's Office for canceling the disposition for refusal to disclose information.



The court ruled that all of the information requested by Moon, except for sensitive information such as some personal information, should be disclosed.



The information requested by Mr. Moon is the investigation record of a case related to the alleged violation of the Public Officials Election Act by Rep. Ha Tae-kyung, which was unprosected by the Seoul Southern District Prosecutor's Office in November 2017.



Congressman Ha argued that there was a suspicion that the Korea Employment Information Service had preferentially hired Moon in April 2017, ahead of the presidential election.



In addition, the Democratic Party accused the prosecution of proclaiming false facts for the purpose of defeating the presidential candidate.



After requesting the disclosure of information, Mr. Moon was rejected and filed an administrative lawsuit.



The court ruled, "It is difficult to see that there is a risk of disclosure of the information requested by Mr. Moon to expose the investigation process for crimes in the Public Officials Election Act, and there is no possibility that the disclosure will cause obstacles to the investigation."
