The 13th Criminal Division of the Incheon District Court (President Eun-seol Ko) sentenced A (35, female) to 10 years in prison for child abuse and fatality under the Special Act on the Punishment of Child Abuse Crimes at a sentencing trial held today (15th) .



The court also ordered Mr. A to complete a 120-hour child abuse treatment program and restricted him from working in child-related institutions for 10 years.



The judge explained, "The defendant beat a young victim, a 3-year-old who called himself'mother', to death," and said, "The victim fell into a brain-dead condition and ended his life miserably."



He then said, "The victim's father complained of extreme mental pain and filed a petition that he wanted severe punishment," he said. "We also considered the fact that the defendant avoided guilt and did not make an honest statement in the investigation agency and court." It.



Earlier, the prosecution sentenced Mr. A to 20 years in prison, saying, "The method of crime is cruel, such as hitting a young victim with a blunt weapon," at a decision trial held in November last year.



Mr. A admitted to the abuse during the trial, but denied the allegations of'lethality'.



He insisted, through a lawyer in court, that "there is no causal relationship between the abuse and the victim's death, and that the victim's death could not be predicted at the time of the abuse."



On January 28, 2019, Mr. A was charged with striking the head of his daughter B (3) with a blunt on his home in Gwangju City, Gyeonggi-do several times.



He also pushed hard on Ms. B's chest to hit the floor or repeatedly beat her with his hand.



Ms. B suffered a brain death from subdural hemorrhage after a skull fracture and died about a month later.



Mr. A denied the charges related to a skull fracture during the prosecution's investigation, saying, "The child fell alone and bumped his head."



The statutory sentence for child abuse and fatality is life imprisonment or imprisonment for more than 5 years, and the basic sentence for the crime recommended by the Supreme Court sentencing committee is 4 to 7 years in prison.



If there is a weighting factor, the recommended sentence is increased to 6-10 years in prison.



However, the Supreme Court's sentencing committee, after weighing the weighting factor and the reduction factor, subtracting the number of reduction factors from the number of weighting factors, recommended that if there are two or more weighting factors, a sentence of up to 15 years in prison through special weighting.
