Judge Kim Jin-won, who was solely responsible for the criminal 9 of the Incheon District Court, sentenced A (63), a math teacher at a middle school in Incheon, who was charged with violating the Special Act on the punishment of child abuse crimes, was fined 3 million won and ordered him to complete a 40-hour child abuse treatment program. Mr. A was charged with emotional abuse by telling his student B (then 13 years old), "Don't you know this. I'm stupid," while attending math classes in a middle school classroom in Incheon in March to April 2018.



In 2017, he made a demeaning remark to his students during class, and he received the attention of the school principal for raising student concerns.



Ms. B said, "I hate the math teacher so much. The teacher (publicly) apologized, but it was not."



Mr. A insisted at the trial, "I never said that I was'stupid' and that "even if I said that, it is not child abuse."



However, the court decided that the accused's remarks, saying that the victim's statements were specific and consistent and reliable, were sufficient to cause mental injury to the victim, who is a student.



Judge Kim said, "The defendant has no criminal history and is currently in poor health," said Judge Kim.



However, he revealed the reason for the sentence, saying, "It is very guilty to abuse the victim by violating the victim during class," and "we also considered the fact that the victim appears to have suffered considerable mental injury."



Mr. A was also accused of sexual abuse by touching Ms. B's back with his hand, but was convicted.



Judge Kim said, "(Regarding sexual abuse), the victim overturned the key statement or made a statement that contradicted the objective data," said Judge Kim. "It is possible that the victim made an exaggeration or misrepresentation while feeling hostile after hearing the words of the defendant's low self-esteem. Cannot be ruled out."
