The Incheon Central Police Department announced today (18) that Mr. A (33, female), who was arrested under the Certain Crimes Weighted Penalty Act, was sent to the prosecution with an opinion of prosecution.
Mr. A left the detention center of Michuhol Police Station in Incheon at around 8:30 am today and took a police van and moved to the prosecution.
Mr. A is accused of killing Mr. B (54, male), who was drunk on a one-way two lane near Eulwangri Beach in Jung-gu, Incheon on the 9th at 0:55 on the 9th. .
The Mercedes car driven by Mr. A violated the center line at the time of the accident, and his blood alcohol concentration was 0.1% or more, exceeding the license cancellation level (0.08%).
The police arrested Mr. A by applying the so-called'Yoon Chang-ho Act', which intensifies punishment if he died while driving while drinking.
In a police investigation, Mr. A stated, "We asked to call a deputy (driver), but the passenger C (47, male), a passenger with a Mercedes, said,'You drank less, so drive.'"
The police are planning to apply an additional charge of assisting a dangerous driver mortal under the Special Act to C, a companion who was accused of assisting with drunk driving under the Road Traffic Act, and sending it to the prosecution during next week.
In the case of assisting with drunk driving, fines are usually issued, but there is a possibility of being sentenced to imprisonment if the crime of assisting a dangerous driver in the Special Act of Yun Chang-ho is applied.
Mr. C is accused of assisting Mr. A's drunk driving by opening the door of his company's Benz vehicle so that Mr. A can get into the driver's seat before the accident.
At the time, the closed-circuit (CC) TV video near the lodgings where they drank together showed that Mr. A approached the driver's seat in the parking lot and pulled the handle of the car door but did not open.
After a while, when Mr. C approached the passenger seat, there was a scene where the vehicle lock was released and the turn indicator lights flashed several times.
Mr. C said in the police, "It is correct to open the car door with the vehicle's remote controller," and "The rest are drunk and I can't remember everyone."
A police official said, "When sending Mr. C to the prosecution, whether to apply the crime of assisting dangerous driver and lethality, we will comprehensively consider the degree of deliberateness or predictability (for Mr. B's death)."
