The National Human Rights Commission of Korea's judgment came out on the complaint of the employee that he was rejected from the renewal contract because he applied for'childcare time' at the local public health center.

According to the Human Rights Commission today (13th), Jung-in A, who was a fixed-term public official at a local public health center, took parental leave for four months from July to October last year. However, even after reinstatement in November of the same year, I felt that I needed more time to take care of my child, based on the current local government service regulations that stipulate that "you can receive up to 2 hours of childcare time per day for childcare and childrearing within 24 months." I applied for additional parenting time at the health center.

However, what returned to Mr. A was not a child-raising time, but a notice of ``not allowed to apply for an extension of the contract,'' and eventually retired in January of this year when the contract period ended.

The public health center argued that "Mr. A had a conflict with other team members and had a problem with his work attitude" as to the reason for not signing the contract, but Mr. A said that the public health center made this decision because he applied for parenting time. Filed a complaint.


As a result of the Human Rights Commission's investigation, the public health center sent a letter to the city hall requesting an extension of Mr. A's contract in October of last year, before Mr. A applied for parenting time. However, only a month later, it was confirmed that the public health center suddenly changed the official letter in the direction of disallowing A's contract extension.

The NHRCK judged that "when considering the post-war situation comprehensively, it is difficult to find other special circumstances that will be excluded from the contract extension, except that A has applied for the use of childcare hours after reinstatement from parental leave." He pointed out that what was excluded from the target was unfavorable treatment for employers of child-rearing hours and discrimination against the violation of equal rights."

The Human Rights Commission advised the health center managers to take precautions while also recommending that local governments direct and supervise such discrimination activities to prevent recurrence.
