Criminal Division 6 of the Daejeon High Court was sentenced to two years in prison and arrested today (10th) by asking her husband, 50-year-old Lee Mo, for murder under the Special Act on Traffic Accident Handling instead of murder.

On August 23, 2014, at around 3:40 am, Mr. Lee was driving a van with his 24 year old Cambodian wife, who was 7 months pregnant at the time, and hit a truck parked on the shoulder near the Cheonan Interchange on the Gyeongbu Expressway.

In this accident, only his wife was killed, but there was a contract to pay 9.5 billion won in insurance for her.

The amount of insurance money was too large, and a sleep-inducing agent was detected in the wife's body.

The court's judgment on this was very different.

The first trial judged innocent, saying, "Only indirect evidence against the defendant cannot prove the crime."

However, the second trial court sentenced him to life imprisonment, saying, "If you look at the fact that you additionally subscribed to 3 billion won worth of insurance two months before the accident, the prosecution is acknowledged."

In May 2017, the Supreme Court returned the case to the Daejeon High Court with the purpose of innocence, saying, "The motive for the crime should be revealed more clearly, but it is not possible."

The Daejeon High Court judged that Mr. Lee had been drowsy. It means there was no intention of murder.

The judge said, "Of the 9.5 billion won in insurance for the death of the victim, 5.4 billion won is not paid at once, and the defendant is not alone, but is shared with other legal heirs." The motive for the murder is not clear, such as that there was no difficulty.”

Regarding the part where the sleep-inducing agent was detected in the blood of his wife, he said, "There is a feeling that the ingredient is not dangerous to the pregnant woman or the fetus," and "It is an ingredient used in various products in everyday life, and the defendant deliberately tried to kill the victim." It's hard to say that it was fed."

Today's ruling, which came out six years after the accident, remains the Supreme Court's final judgment.
