The court judged that if you had a panic disorder while arguing with your boss, who was stressed out, you should admit to a work disaster.

According to the legal community on the 3rd, the Seoul High Court Administration Division 6 (Lee Chang-hyung Choi Han-soon Hong Ki-man, Deputy Judge) broke the first trial in a lawsuit filed by Mr. A against the Korea Workers' Compensation and Welfare Service and ruled against the plaintiff.

Mr. A, who worked as a team leader at a government service company, was diagnosed with panic disorder in December 2017.

He had his first panic attack in November of the same year after having a dispute with his boss, Mr. B.

Mr. A insisted that the panic disorder had occurred because Mr. B was stressed by taking overwork or making up to 40 calls a day, regardless of working hours, but filed a lawsuit when the Korea Labor Welfare Corporation did not accept it.

The first trial did not accept Mr. A's claim that it was difficult to acknowledge the causal relationship between work and onset.

However, the Court of Appeals overturned the judgment.

The judiciary said, "As Mr. A showed the symptoms of panic disorder seizures for the first time and the psychological state, he found that he had a psychological stress in the relationship with his bosses. "There are."

In addition, after the onset, Mr. A was rejected for a new contract, and after six months of quarrel, he was judged unfairly dismissed by the Central Labor Relations Commission. Then, the company presented Mr. A, who lives in Gangwon-do, to Seoul as the basis for the situation that he eventually quit.

The Court of Justice said, "even if Mr. A had a biological factor with a high likelihood of developing panic disorder, it was caused by a series of stresses such as conflicts with business managers, unfair dismissal from the company, and relief after reinstatement. I thought it could be worse.”

He continued that even if the cause was not directly related to the content and extent of the work, the causal relationship is recognized as much as it can be regarded as a result of the work process or employment relationship with the company.
