A taxi driver who was sentenced to 1st sentence for infringing on drunk passengers was convicted of an appeal.

This is because it is difficult to admit that the victim's statement that seemed to be unable to clearly remember the situation at that time is true.

According to the legal community on the 15th, a senior male taxi driver A was charged in March 2018 with a female college student B in Yuseong-gu, Daejeon, and was accused of forcing Mr. B after he arrived near the destination university dormitory.

Judge Lee Heon-suk, the Daejeon District Court who took the first trial, made statements that the victims generally corresponded to the crimes, the location of the victims' getting on and off, and the records of the defendant's taxi navigation system (GPS), and the accused's driving taxis at the time of the incident. He was found guilty and sentenced Mr. A to one year of probation in April.

Throughout the trial, Mr. A, who denied the charges, saying, "I don't remember having the victim in a taxi, and I have never molested a passenger."

The first sentence of the Penal Code of the Daejeon District Court (Judge Sung-Mook Yoon) judged that A could not be held guilty.

Although the judges can admit that the victim had been forcibly molested, it was difficult to determine that the perpetrator was the accused immediately.

This is because the statement of the victim who was drunk at the time was rather unclear.

The judge said, “The victim's sexual harassment impression and face, etc., which were stated by the investigative agency are different from the accused.” The location of the victim in the taxi also differs about 150m by one block from the investigation report and the statement of the acquaintance of the victim.

The victim is said to be unable to accurately remember the color and color of the taxi.

The judge said, "At the time of this incident, a taxi was operated similar to the path of the victim, but it is difficult to conclude that the passenger was a victim immediately. "Because it is the beginning of the semester, many college students use taxis to go to dormitory from a pub. It seems to have been frequent."
