The case, considered to be sensitive, was handled with the utmost discretion. It concerns a couple of magistrates, married, followers of libertine websites allowing them to contact partners for sexual relations with others. An aspect of their private life in no way reprehensible between consenting adults. But in autumn 2019, according to information from Europe 1, a preliminary investigation was opened when the father extended his usual proposals. To his interlocutors online, he offered the possibility of having sex not only with his wife but also with their little girl, barely 12 years old.
Multiple proposals for several months
If no internet user responded favorably to his offer, the messages were, however, reported to the police and the justice system, which seized them. Some 10 months of investigation have thus highlighted the repeated proposals of this man, who did not hesitate to disseminate in support of his messages a photo of his daughter in a swimsuit. On June 4, the couple of magistrates were taken into police custody and questioned by investigators from the judicial police.
The wife said she was unaware of the proposals made online by her husband. She has been released and is not the subject of any legal proceedings at this stage. Her husband is said to have acknowledged being the author of the messages, but he claims that they were only "fantasies" and that he would never have allowed such acts to take place. As for the couple's daughter, heard by the investigators, she would not have suffered any sexual abuse.

10 years in prison
At the end of his police custody, the father of the family was referred to the Besançon parquet floor, where the file was disoriented, the couple of magistrates working in Dijon. The husband was charged with "aggravated bribery of a 15 year old minor" and "offer, even without effect, to a person to commit rape, sexual assault or corruption of a minor ". For these crimes, he theoretically incurs a maximum penalty of 10 years in prison and a million euros fine.
His requested suspension
Former judge of the children fifteen years ago, this magistrate was left free under judicial control with in particular an obligation of care and the prohibition to exercise a professional activity in contact with minors, pending his future trial in correctional . The case was also the subject of an internal report to the Ministry of Justice. Also according to our information, the Keeper of the Seals, Nicole Belloubet, seized Thursday the Superior Council of the magistrature (CSM) in order to pronounce the temporary suspension of this judge.
