Immediately after getting off at the Incheon International Airport transfer terminal in Southeast Asian countries in February, Mr. A told the airport security agent that he wanted to apply for refugee status, but he couldn't even receive an application.

According to the Refugee Law, the immigration authorities interpreted that refugee applications can be submitted when they are screened for immigration.

With the help of a human rights group that learned the hard facts, Mr. A opened the way for refugee review.

The court has raised Mr. A's hand saying that it is against the refugee agreement to not give the refugee an opportunity to apply for refugee status if he has not arrived at the immigration office.
