[SBS Special] Boy

stands in courtroom ① ● 'Put down tactile boy'… One million national petitions

Last spring, a new college student who had a part-time job delivery job died in a hit-and-run accident. However, the driver of the Samsoni car was surprisingly a junior high school student who was only 13 years old. In the car, seven more people were on board, but most of them are not subject to criminal punishment for being a 'lawful boy' under the age of 14.

Even after committing crimes such as theft and unlicensed driving several times before, he had no choice but to be punished and ended up taking the life of a young man. Moreover, the perpetrated students left the post on the social media after an accident, and left a post that does not seem to show off or reflect on the crime.

"My child is dying and there is no one to be punished. But if they are not punished, these children will commit another crime later. The second victim, the third victim will come out again." -Bereaved victims of teenage unlicensed accidents A

'criminal boy' who is 14 years of age or older and under 19 years of age is subject to prolonged or short term delinquency in a criminal trial or judicial protection depending on the crime. The 'Corruption Boy', who is 10 years of age or older and younger than 14 years of age, receives only protective measures that do not leave a criminal record. Because of this, some suspicions have raised concerns about exploitation of criminal punishment.

● Appeal of victims who do not reach court

Last year, high school student A, who was sexually assaulted against elementary school students, was charged with arrest. It was a heavy crime for an adult to be sentenced to more than 10 years, but the Criminal Tribunal sent the Army A to the Boyhood. The reason was that the perpetrated student was young, violent, and reflective. Upon receiving a juvenile trial, the longest juvenile detention will be disposed of for two years, and no criminal record will be left.

"Isn't it a reflection that I'm sorry? The abuser told the judge that he would apologize to study hard and become an attorney. I didn't apologize to my child for being sorry."

-Interview with the victim's mother After being sent to the Middle School Division, the victim's family cannot know the date of the trial or attend the trial. It is because of the principle that the hearing of the boy's trial is not disclosed. Even on the day of the final sentence, the families of the victims of the case had to be kicked out of the juvenile court. Eventually, the victim did not know what the abuser was subjected to.

"You have to change the law of the boy. It's not the law that protects the boy, but the act of persecuting the 'victim of neglect' should be called 'the act of triggering a perpetrator' by punishment. '

-Interview with the victim's family 中

Juvenile law , protection or indulgence, the age standards of juveniles have not been adjusted since the establishment of the Juvenile Act in 1953. It is suggested that as the amount of information received by youth increases, the age standard should now be reduced to 13 or 12 years. On the other hand, however, there is an opinion that the violence against boys is only a small part, and it is necessary to understand the home environment of boys who are not cared for.

"The amount of information that a 14-year-old boy 60 years ago and now accepts is different. We need to create a realm of flexibility to punish according to sin rather than just putting the boy under protection." -Dr. Jae-Hyun Seung, Korea Criminal Policy Research Institute

"Most protection boys are in an unfortunate and unfortunate environment where they have not committed suicide. There was no adult to hold on to them. Full responsibility for the responsibility of flying to children who never even had the chance to learn right or wrong. Can I? " -Former President of the Boys, Prof. Young-Sun Han of Kyonggi University

Boys' Law, Who Should Be Protected

Parents and teenagers who are neglected due to the care of their parents will need the warm attention of adults who teach wrong and the opportunity to stand up again . However, compared to the pain of the victim, the punishment of the youth is negligible, and a large number of people urge the revision of the Juvenile Act.

The demand for the abolition or amendment of the Juvenile Act hotly hits the petition bulletin board whenever there are violent incidents by the boys. However, it was soon forgotten and the amendment to the juvenile law did not exceed the threshold of the National Assembly. Meanwhile, other boys, victims of the crime, are left in pain.

SBS Special 'Boys, Standing in the Court' examined in-depth discussions on the revision of the juvenile law by covering the recent rapidly increasing youth crime cases and analyzing the progress of the cases.
