The Constitutional Court found that it was against the Constitution for the police to shoot a water cannon directly against Baek. It violated Nam June Paik's right to life and freedom of assembly.

At the time, the police shot water cannons at Baek's head and chest, and after the loss of consciousness, the water continued.

Mr. Baek, who had a fractured skull, was in a brain-dead state and died ten months later without regaining consciousness.

The bereaved family filed a constitutional claim that the so-called 'direct killing act', in which the police shot a water cannon at Baek, violated the right to life and freedom of assembly.

Today (23rd), 4 years and 4 months later, the Constitutional Court made an unconstitutional decision.

Direct water sprinkling can have fatal consequences for life and body, so it should be done only in situations that are absolutely necessary.
