China News Service, December 26. Recently, the website of the General Administration of Sport of China released the "Sports Arbitration Rules" and "Organizational Rules of the China Sports Arbitration Commission". The two rules will come into effect on January 1, 2023.

  According to the "Organizational Rules of the China Sports Arbitration Commission", the China Sports Arbitration Commission (hereinafter referred to as the Sports Arbitration Commission) is an arbitration institution established by the State Sports General Administration (hereinafter referred to as the General Administration of Sports) to deal with sports disputes.

The Sports Arbitration Committee is composed of representatives of sports administrative departments, sports social organizations, athletes, coaches, referees, and sports and legal experts.

  The "Sports Arbitration Rules" stipulates that the Sports Arbitration Committee accepts the following cases:

  (1) Disputes arising from dissatisfaction with disqualification, cancellation of competition results, and suspension of competition decisions made by sports social organizations, athlete management units, and sports event organizers in accordance with doping management or other management regulations;

  (2) Disputes arising from athlete registration and exchanges;

  (3) Other disputes arising in competitive sports activities.

  Arbitrable disputes stipulated in the Arbitration Law of the People's Republic of China and labor disputes stipulated in the Labor Dispute Mediation and Arbitration Law of the People's Republic of China are not within the scope of sports arbitration.

  According to reports, the arbitrators of the Sports Arbitration Committee should be fair and decent and meet one of the following conditions:

  (1) Having practiced as a lawyer for eight years;

  (2) Has served as a judge for eight years;

  (3) Obtain legal professional qualifications by passing the national unified legal professional qualification examination, and have been engaged in arbitration work for eight years;

  (4) Engaged in law, sports research or teaching work and has a senior professional title;

  (5) Have legal knowledge and have been engaged in sports practice for eight years.

  In addition, sports arbitration special procedure rules apply to sports disputes that need to be dealt with immediately during major sports events or within ten days before the opening ceremony.

  In sports arbitration related to anti-doping, there should be at least one anti-doping arbitrator, and there should be an arbitrator with a legal background or legal professional experience.
