Traffic Law This is the new rules and sanctions
Study Overtaking will be more dangerous
The General Directorate of Traffic (DGT) has raised its chest, with reason, due to the decrease in accidents and fatalities in the last decade.
But for a long time it has insisted on the need to
eliminate the permissiveness to exceed
the speed limit established by 20 kilometers on two-way roads when overtaking another vehicle.
From this Monday it is mandatory
.
After the long parliamentary discussion of the
Law on Traffic, Circulation of Motor Vehicles and Road Safety that came into force
, the general director of Traffic,
Pere Navarro
, managed to get this approved
controversial measure, highly questioned by the drivers' associations but applauded by those that welcome the victims of the road
.
The main argument of the DGT to promote the regulatory change is that
the number of claims has risen worryingly
, especially head-on collisions between vehicles, and in this situation it has been able to impose this criterion.
Thus, it states that
in 2019, 16% of those killed in accidents died in a frontal crash
, most of the time in overtaking maneuvers.
But the truth is that
there are no technical studies that support the relationship of this margin with claims
and if there are, they have not been disclosed.
It found the opposition of Congress in the first instance, although the
Senate
and later the Lower House admitted the elimination of the controversial margin
that, Navarro insists, is not allowed in any other country in our environment.
boiling debate
Once the sieve was passed, Navarro explained at a conference that
in a year "we will have to see if this 20-kilometre rule goes well or not. We don't want to get lost in a debate.
The data will give us answers."
The Director of Traffic commented that
he was about to remove this matter from the Law
after collecting testimonies from people who regularly traveled on secondary roads and said they needed that room for manoeuvre.
"
We understand his concern...
But I insist on the incalculable value of
meeting with all parliamentarians without haste and outside the focus of the media,
which will help find the measures that can be adapted."
But like Navarro or not, the debate is boiling.
The study published by EL MUNDO in April last year
, carried out by Professor
Juan José Alba
at the request of the
DVuelta
association , explained the risk of overtaking without exceeding the 90 km/h limit on a conventional road:
it takes three times longer to complete the maneuver and travel 112 meters more
.
In conclusion, the probability of a head-on collision with another vehicle would be greater than if it overtakes at 110 km/h, as was legal until the day before yesterday.
"
It has not been proven that it is actually a measure that contributes to the reduction of road accidents
. The time to execute the maneuver and the distance for it are increased," argues
Ignacio Fernández
, director of the
RACE Foundation
.
fundraising mood
The president of the Associated European Motorists
, Mario Arnaldo, maintains this idea
, who sees in these and other new measures of the Law a clear spirit of collection and that in the case of the 20 kilometers
"there is no European regulation in this regard"
, according to picked up Europa Press.
From the
Platform of Motorists for Road Safety
, the spokesperson María José Alonso, has branded
as "barbarous" and "madness"
to prolong the time to carry out "one of the most risky maneuvers" of driving.
It also sees a collection effort, and affects a very common argument among drivers: the measure tries to
preserve hundreds of thousands of euros that are not collected in violations detected by the speed cameras
, which warn of speeding, but if it is alleged that was being advanced -whether or not it is true- the appeal is won.
"unnecessary alarm"
The improvement in the operability of the speed cameras is "clearly promising" in the words of Jesús Monclús,
from the Mapfre Foundation, who calls for "patience" instead of stubbornly overtaking at all costs.
Alonso believes that the norm has come from the pressure of the associations of victims
, who celebrate the legislative change.
"[The norm] is being used to generate an alarm," said Francisco Canes, of the
State Association of Accident Victims
, because "it is almost impossible to sanction an overtaking."
Canes celebrates the change of
"a law that is quite well done"
.
For her part,
Ana Novella, president of Stop Accidentes
, reminded Europa Press that "this permissiveness of 20 kilometers above
it made people run more than normal and risked when overtaking
another vehicle on the road. Frontal crashes there have been many as a result of it and even road exits. With which, we are in favor. It is a measure that is nothing new in Europe.
It has been in place for a long time
".
