• Competition Fine of 171 million euros to car brands per cartel

More than 10 million individuals and companies that bought a new vehicle between February 2006 and August 2013

have the door open to complain to the brands from which they acquired their car once the Supreme Court is ratifying the fines that the National Commission of Markets and Competition (CNMC) imposed on them in 2015 for having created a cartel.

In particular, it accused them of having exchanged confidential information to control the distribution and after-sales market.

The investigation affected the following brands:

Alfa Romeo, Audi, BMW, Chevrolet, Chrsyler, Citroën, Dodge, Fiat, Ford, Honda, Hyundai, Jeep, Kia, Lancia, Lexus, Mercedes, Mitsubishi, Nissan, Opel, Peugeot, Porsche , Renault, Seat, Skoda, Toyota, Volkswagen and Volvo

Some of them no longer operate in the Spanish market.

And the super regulator imposed one of the largest fines in its history: 171 million euros.

Although then he condoned the sanction (about 40 million) to those of the Volkswagen Group (Audi, Porsche, Seat, Skoda and Volkswagen) for having collaborated with the CNMC.

A situation that would not free them, in principle, from the claims that customers can file.

The Supreme dismisses the reason to the brands

In December 2019, the National Court ratified the fines,

dismissing the claims of the manufacturers.

And the Supreme Court has been doing the same

in recent months with 15 of the brands and it is expected that it will shortly adopt the same resolution with the rest of the brands.

According to the Cremades & Calvo Sotelo law firm, this has meant that thousands of clients are already preparing lawsuits to claim the theoretical surcharge they paid for the vehicles they acquired.

For this they have a period of one year from the publication of the Supreme Court's sentences.

In April this year, a Cadiz court already ruled in favor of a client and sentenced an Audi and Volkswagen dealer to pay him 2,000 euros for the purchase of a vehicle in 2010, which cost him 25,000 euros.

The company was also ordered to pay interest and costs.

Up to 10% of the overcharged price

Depending on the brand and model purchased, that amount could be around 2,500 euros on average.

In a vehicle that cost 15,000 euros, the compensation could range between 1,500 and 2,250 euros,

plus legal interest, they clarify from the firm.

Although the company Consultores Técnicos estimates that the surcharge

could be around 10%, which makes the calculation easier.

To carry out the claim,

the latter company recommends providing the maximum documentation, at least the purchase invoice, the proof of payment of the rental or leasing of the car, in addition to the technical sheet and contracts.
