has admitted to the judge that he defrauded taxes during his first stage as coach of the white club.
Ancelotti has appeared this morning as investigated before the
Court of Instruction number 35 of Madrid
and has recognized that he did not pay taxes correctly during the 2014 financial year, in which the Tax Agency attributes the commission of one of the two tax crimes for which he was denounced by the Prosecutor's Office a year ago.
According to the Italian coach, he was "poorly advised" at that time and has offered the court immediate payment of the amount claimed that year, in which the Treasury attributes him to have evaded more than 300,000 euros.
A figure to which the fine and interest should be added.
During his court appearance, in which he has been accompanied by the lawyer Carlos Zabala, head of the Clifford Chance Criminal Area, he
has nevertheless fought the second accusation
that the Treasury brings against him for a crime against the Public Treasury.
Although Ancelotti acknowledges having incurred a tax offense in
2014
, he denies having evaded taxes in
2015
, a year in which he was dismissed as a Madrid coach and left Spain. In this section, the coach maintains, against the criteria of the Treasury,
that he did not spend 183 days but 158
in Spain
and that he can prove it. For this reason, he has made available to the court the
geolocation of his mobile phone and the plane tickets
for that year to demonstrate that he did not stay the minimum time to be considered a tax resident in our country.
In this line, he asks that the Treasury apply the same criteria that he used with him in 2013, when in his opinion he found himself in a similar situation, and in which he not only accepted to pay taxes as a non-resident in Spain but also returned part of his taxation. During the last months Ancelotti and Hacienda have held talks to
try to close a compliance agreement
but it has not materialized due to technical discrepancies around 2015.
Hence, the Treasury not only has not rectified its initial position but, as revealed by EL MUNDO,
has
ordered the seizure of his new salary with Real Madrid
for a total amount of 1,420,120.51 euros. This amount derives from a tax debt amounting to 1,396,875.33 euros to which the Treasury adds 23,245.18 euros for late payment interest.
The Tax Agency maintains that Ancelotti evaded taxes between 2014 and 2015 voluntarily.
That is, "with the aim of unjustifiably evading its obligations to the public treasury."
According to the Prosecutor's Office, Ancelotti intentionally excluded from his tax returns his income from the exploitation of his image rights and the Madrid team in order to
"hide his identity as a recipient of income"
and supported by "a complex network of instrumental companies" .
In this way, argues the Public Ministry, "neither he himself nor any of these companies (some residents, for this purpose, in a tax haven) had to pay for the large amounts received."
