and
Antonio Luna
have recognized this Wednesday before the judge that they recorded the sexual video that went viral in October 2016 without having the consent of the third person who appears in it, a young woman from San Sebastián.
As a result of this confession, the
request for forgiveness and to compensate the victim with 110,000 euros
(an amount greater than that claimed), both the Prosecutor's Office and the private prosecution have reduced the request for penalties for the events from five to two years.
The Criminal Court number 3 of San Sebastián welcomes from this Wednesday the trial for the recording and dissemination of said sexual video.
The events collected in the video that ended up going viral occurred at Luna's home in April 2016, when both he and Enrich were Eibar footballers.
During the recording, the victim clearly expresses her request that the sexual relations that she was having with the two footballers not be recorded
, to which they both ignored.
Luna, now a Girona player, has even acknowledged during his statement that the day after the events both he and Enrich had a "long conversation" with the victim, in which she demanded that they destroy the recording.
He has also acknowledged that they deceived him, telling him that they had already done it, when in reality it was not like that and
they sent it to his then partner at Eibar Eddy Silvestre

Both Enrich and Luna agree that Silvestre, with whom they maintained a close friendship relationship, was the only person to whom the video was sent and they hold him responsible for its subsequent dissemination.
The two players have expressed their regrets for what happened and Luna has even burst into tears during her statement

Silvestre, also accused and for whom the Public Prosecutor's Office and the private prosecution claim three and two years in prison, respectively, has denied his involvement in the events.
The now Albacete player has acknowledged that he received the video through WhatsApp, although he has said he does not remember if he received it through a private message or in a group, but has denied being responsible for its subsequent dissemination.
He has also commented that for him it was "one more video", because
Enrich was "a person who exhibited himself", that he had knowledge that he practiced group sex with Luna and recorded himself and that it was "usual" for him to send "videos like this "

The victim has also testified, although he did so behind a screen and without the presence of the media in the room.
Her lawyer, Iñigo Iruin, explained after the session that
the young woman feels "relief and satisfaction" after the recognition by Enrich and Luna that she never consented to the recording of the video or its subsequent dissemination

The lawyer also highlights that the statements of the footballers "have made it possible to find out the totality of what happened, by stating unequivocally, in a categorical manner, that the only person to whom the video was handed over or transferred was Eddy Silvestre" and that, therefore, "the diffusion was produced by him without any doubt", according to statements collected at the courthouse doors by Europa Press.
A version that matches the one Enrich gave the victim in his only telephone contact after the viral spread of the video.
