The closure of the Nissan factories in Barcelona, ​​for which an agreement was reached less than two weeks ago and which will not take place until the end of 2021, is becoming a path full of thorns for the Japanese multinational.

The last obstacle has been set by Acciona, the supplier that is in charge of internal logistics at the Zona Franca, Montcada i Reixach and Sant Andreu de la Barca plants and which has unilaterally and immediately terminated its contract.

This decision complicates the resumption of the activity of the factories starting next Monday, as the constructor and the workers had agreed in the agreement on the closure. They have been on strike since the end of May and Nissan needs to fulfill pending orders for the Mercedes X-Class pickup. Failure to do so risks a hefty penalty.

The contract between Acciona and the Japanese manufacturer expired on March 31, 2021. However, and in what Nissan describes as an "unjustified action", on August 6 the former communicated to them "the termination of the contract, unilaterally and immediate, from August 10 ». According to Acciona, the measure has been taken due to the "lack of response" of the brand towards its suppliers and subcontracted companies, which in their case has led them to an "unsustainable situation" after having all their available resources "stopped and unused " since March. For this reason, it has announced the presentation of an ERE for the termination of employment for its 500 workers in the plants, which "it will carry out with an agreement or are the".

The scenario could be further complicated by the threat of an indefinite strike by several of those subcontracted companies that provide their services in Barcelona. There are a dozen, some operating for decades and totaling about 1,500 employees. Among them, in addition to Acciona, are Segula (maintenance) and Tecnove (dining room service).

Lawsuit for 'illegal transfer' of workers

The problem is that its employees, in the event of dismissal, will not have the beneficial conditions that the more than 2,500 direct employees of Nissan have managed to agree on . Conditions that are far above the legal ones and that include early retirement with up to 90% of the net salary or indemnities of up to 60 days per year worked without limit of monthly payments. In addition, the company has guaranteed that there will be no "traumatic" exit until December 31, 2021, when the three factories finally pull down the blind and that is one year later than initially planned.

Faced with this situation, some 300 employees of the subcontractors have filed a lawsuit in the social courts for "illegal transfer of workers", since they consider themselves workers of the car manufacturer and claim to be treated as such. At the moment, they only have the promise that their companies will be part of the working group that will look for industrial alternatives for the facilities.
