“I didn’t touch her car, and I don’t need to worry”
The case of Alexander Kokorin and Pavel Mamaev, which the whole country discussed throughout 2019, gradually began to be forgotten. Football players served their sentence and successfully resumed their careers. Forward “Zenith” on a loan went to “Sochi” and has already scored three goals in the current season of the RPL. All the more unexpected was the news of the lawsuit against the players, as well as two other defendants in the case - Cyril Kokorin and Alexander Protasovitsky from the TV presenter Olga Ushakova (Masliy) in the amount of more than 300 thousand rubles. Information about this was officially confirmed in the Savyolovsky court.
“In the court proceedings, the claim of Masliy O. V. to Kokorin A. A., Kokorin K. K., Mamaev P. K., Protasovitsky A. S. for the recovery of jointly and severally pecuniary damage in the amount of 321,075.03 rubles. The woman demanded compensation for material damage. On October 8, 2018, during a scuffle of four persons involved in a case with a TV presenter driver Vitaly Solovchuk, a glass was broken in a woman’s Mercedes car in a Beijing car in a woman’s car. According to her, in the year and a half that has passed since then, she never waited for money.
“I can’t contact my lawyer yet. But yes, probably only today the statement went to court, so these conversations went. We were also surprised that we had to sue on such a matter. Least of all I like the courts, but the damage has been done, and there must be compensation for this damage. I do not personally participate in this business at all, I have four children in shops and quarantine. I’m surprised that such “important” news hit the press, ”the newspaper quoted the victim as“ Gazeta.ru ”.
In turn, the lawyers Kokorin and Mamaev were extremely surprised by the lawsuit from the woman. Thus, Igor Bushmanov, representing the interests of Pavel, emphasized that she was not recognized as a victim in this case. Not only that, it turned out that his client made a nominal money transfer in the amount of 200 thousand rubles back in December 2018, but Ushakova (Masliy) “did not use them”. Despite this, Mamaev is ready to compensate the presenter for damage without legal proceedings.
“Today I phoned Paul, he said:“ For God's sake, I’m always ready - name the amount. ” He takes this issue upon himself, is ready to individually compensate everything, ”quoted Bushmanov as saying“ Championship. ”
The lawyer of Kokorin Tatyana Stukalova confirmed what the colleague said. She recalled that Ushakova (Masliy), after passing the verdict, had no material claims against the defendants in the case and did not go to court with a civil lawsuit. And the Sochi striker, in her words, has nothing to do with this episode.
“My client Alexander Kokorin did not cause any damage to either the car belonging to Olga Ushakova (Masliy), or her driver Vitaly Solovchuk. In this connection, neither Alexander Kokorin himself nor his defense consider him to be a proper defendant in this claim. The same arguments were presented by me in a cassation appeal against the verdict in this case, and in the near future, the preliminary date, May 13, 2020, will be assessed by the judges of the second cassation court of general jurisdiction, ”R-Sport quoted Stukalova as saying.
This was stated by Kokorin himself. According to Alexander, he did not touch the car Ushakova-Masliy, and therefore he had nothing to worry about.
During the hearing, the TV presenter said that after beating Solovchuk, the glass of the front door was broken in her car. The damage caused was not limited to this - the interior of the car was stained with blood. The woman promptly wrote a statement to the police, and her driver was taken to the hospital.
“Obvious injustice was committed towards the guys”
On October 8, 2018, the brothers Kokorins, Mamaev and Protasovitsky took part in two brawls at once in the center of Moscow. A few days later, young people were detained. And in May 2019, the court convicted all four defendants in the case. The Kokorins were sentenced to one and a half years imprisonment, while Mamaev and Protasovitsky were sentenced to one and five months in a maximum security colony.
Given the time spent in the pre-trial detention center, all of them were supposed to be released at the end of 2019, but the court granted the Kokorins and Mamayev’s request for parole, and they left the colony in September. However, the players and their lawyers decided not to stop there. They intend to seek a review of the sentence. Therefore, in early March, an application was submitted to the second court of cassation. Its consideration was scheduled for April 20, but later due to a pandemic, the coronavirus was postponed to May 13.
At the same time, lawyers believe that the truth in this situation is on their side. In particular, Bushmanov explained: according to the verdict, Solovchuk allegedly suffered the same injuries to all the defendants in the case. And most importantly, in the company's actions, according to the lawyer, there were no hooligan motives. Stukalova insisted on this, who complained that the court did not take into account all the evidence available.
“You know, we already have in our hands a decree of the second constitutional instance that the defense’s arguments deserve attention. Of course, we do not expect full justification, but we hope for a retraining. Kokorin himself in a recent interview with the famous blogger Yevgeny Savin said that he intends to go all the way to the revision of the verdict.
“There should have been an appeal, but it will be canceled due to the virus. Why do this? Under the law, we will sue until the end, we intend to go through all instances. The main court is the Supreme Court. I’m very interested in how they will react to our business, ”the footballer emphasized.
Lawyers are ready to go to the end. Moreover, Bushmanov suggests that the Kokorins, Mamaev and Protasovitsky may even be convicted if a verdict of hooliganism is passed.
“What will it give if the guys are already free and live a quiet life?” Moral satisfaction is the most important thing. A person does not want to live with the stigma of a bully, to be responsible for actions that he did not commit. We will defend our position to the end - there was a clear injustice towards the guys, ”the Championship lawyer said.
