The Tax Agency acts again against a top-level player within the framework of the fiscal tax raid that has been deployed in recent years in Spanish football. The new victim of the Treasury for the taxation of their image rights is the Real Madrid captain Sergio Ramos , who has just imposed a penalty of one million euros.

The Treasury has drawn up an act for the soccer player corresponding to the 2012, 2013 and 2014 financial years in which he concludes that he used a company of his property, Sermos 32, SL, based in Spain, to transfer his advertising revenue to it and pay less taxes irregularly

According to they have been able to confirm to EL MUNDO sources close to the Tax Agency, the Sevillian defense has paid in installment the amount -which includes the defrauded quota, the sanction and the interests, by the administrative route- and is currently aware of Payment with the Treasury.

However, the Madrid player has filed an appeal in which he strongly questions the decision. He argues that at all times he has strictly followed the taxation criteria set by the Tax Agency in a previous inspection to which he was subjected and trusts that the fine will be annulled and returned.

Ramos was recently required by the Inspection, as it is doing with almost all players that generate significant advertising revenue, to examine for the second time the operation of the society that exploits its image rights.

The Treasury had already claimed all the data of its company years ago , specifically in relation to the years 2006, 2007 and 2008. That first requirement resulted in a minor penalty, linked not with the transfer of the image rights of the player but with the remuneration that Sergio Ramos de Sermos 32, SL should charge when attending events or recording advertisements.

There they finished the first problems of Ramos with the Treasury. However, from that moment, and despite the fact that the player respected the taxation criteria established by the Treasury during the first review, the Tax Agency has made a more restrictive interpretation and has sent a new sanctioning act.

It considers that, despite the fact that the contract for the transfer of image rights continues to be the same one that was already examined during the initial inspection, Ramos has benefited irregularly from the use of Spanish society to save the referred figure of one million Euros

In summary, the Treasury claims to the Spanish international the 20 tax points from which it has benefited from collecting its advertising revenues through a company instead of having declared them in full as a natural person. That is, the difference between the 25% that he paid through his society compared to the 45% that corresponds to him in his personal income tax .

Other players

Ramos is incorporated in this way to the bulky list of players who have had to carry out million-dollar regularizations with the Treasury in recent years and who lead, with convictions for tax offense, stars who play or have played in the Spanish League as Cristiano Ronaldo or Lionel Messi .

The case of the Andalusian player differs, however, from the other major disciplinary proceedings against top-level players. Ramos has never used companies located in tax havens or frontmen to collect their image rights. From the first moment the defense had a company established in Spain, declared to the Treasury, without interposed managers, and in which it appeared with its name and surnames.

The configuration of a company in Spanish territory, following the criteria of its team of advisors, has freed the Treasury from considering that its tax problems should be resolved through criminal proceedings. So it faces only an administrative claim .

Quite the opposite of what the Treasury has automatically estimated with those, such as Cristiano Ronaldo or Messi, employed offshore companies and fiduciaries to hide their identity from the Spanish tax authorities.

The penultimate player who had been involved in problems with the Treasury is the athletic Diego Costa , who admitted a few days ago the commission of a tax offense and must pay almost two million. Now, Ramos takes the turn.
