The National Court files the complaint against Messi for fraud and money laundering with its Foundation

The judge of the National Court María Tardón has agreed to file the complaint filed against FC Barcelona player Lionel Messi , his father, his brother and others for crimes against public finances, accounting crimes, fraud and money laundering in relation with the Messi Foundation. The complainant was a former employee of the Foundation.

In her order, the magistrate explains that the complaint includes an account of events based on journalistic news without providing a single element of personal and direct knowledge without credibility, which, according to the judge, would imply the use of incompatible prospective investigations. with the principles that govern the criminal process.

According to the Hearing, the judge adds that the second part of the complaint refers to possible fraud in Argentina, where an investigation has been initiated in an economic criminal court. Also in this section the judge affirms that there is no necessary credibility in the facts denounced for the assumption that they could be subject to investigation by the Spanish jurisdiction.

In its resolution, the judge focuses on the third of the sections of the complaint in which the complainant specifies his relationship with the Foundation and certain actions of the latter. Tardón affirms that they do not fit facts of criminal relevance, notwithstanding the fact that he can file as many claims as he deems appropriate, but by civil means, not by criminal law.

The complainant, Federico Rettori , argued in his complaint that "it is notorious" that Messi, his brother and his father "have used the Leo Messi Foundation as a tool to generate a screen and thus enhance the image and income of the Foundation [. ..] without the slightest intention of allocating the funds to social actions and projects such as those they are required to do according to their functional mandate ".

The file decreed by the magistrate is not provisional but definitive, so when it is firm - it is still appealable - it will mean that the matter can no longer be reopened criminally.
