The Court of Instruction number 1 of Barcelona ordered provisional detention for S.R.R., a monitor of recreation and the dining room of the French Lyceum of Barcelona accused of sexually assaulting four five-year-old students, two boys and two girls. In his resolution, magistrate Joaquín Aguirre points out that the suspect's action "seems to be a pedophile behavior that extends, at least, up to four minors from the same school, who also belong to different classes" all of children.

At the end of last year the accused, who has a mental disability of 33%, provided his work services in this school as a monitor since he monitored the preschool children during recess and at lunchtime in the dining room of the center. According to the judge, in early November the minors were inside a sink next to the courtyard when the suspect entered and allegedly masturbated in their presence, ejaculating on their clothes. In January of this year, the accused allegedly took one of the minors to a booth that is in a secluded part of the playground and there sexually assaulted him with penetration while investigating whether the other student suffered the same. "From the account that the minors made to their parents, this conduct had happened on several occasions," according to the judge.

The minors recognized the suspect in the images shown by the Mossos d'Esquadra after the complaint of the parents while the medical reports of exploration of the girls indicate that they have "lived different situations of sexual violence". The children explained that the suspect gave them candies, chocolates or sweets to take them to the booth in the schoolyard. All the alleged abuses occurred at noon after lunchtime.

"In short, in our opinion, there are enough indications to consider that the accused allegedly could have committed the facts denounced by the parents and related by the children," says the judge who recalls that the Mossos inspected the school to identify the places identified by the victims. In addition, the court notes that "children are extremely vulnerable" since they are five years old.

Therefore, the judge orders the entry into prison of the suspect considering that there may be a risk of "criminal repetition" since "the investigated seems an alteration of his sexuality that makes him want to have sexual contacts with young children. This contact can be described as horrendous because it causes very serious psychological trauma to the victims."

"It is a type of offender who is usually a repeat offender and the future crime to be committed would be one of the most serious punished in the Criminal Code, only below crimes against life (homicide or murder)," says the magistrate who believes that "the risk of criminal repetition cannot be avoided with a simple measure of distance, Since it is absolutely uncontrollable by the authorities such removal of minors, since there is no public register that can be accessed by educational centers, or recreational activities with children to check if a person is registered in that file. With less reason could be controlled by the police if the investigated approaches other children in a park or some home "indicates the judge to argue the provisional detention of S.R.R.

In addition, the court details that the "defendant took the boys behind the booth so that they would not see him and in the case of the girls he took advantage of the fact that he was alone with them in the bathroom. Therefore, the defendant knows how to distinguish that the act he carried out with children was reprehensible and that is why he sought a public separation from the other people in the yard. " The children told police that the defendant allegedly threatened to harm them and their families if they told anything.
