The crime took place in the man's apartment. When emergency personnel arrived at the scene, the boy was lying dead in his crib and the man was arrested.
In questioning, he has admitted to inadvertently causing the child's death, but has denied murder. He himself says that he tried to silence the child.
There were reports of concern
The man has a history of mental illness and has previously been admitted to inpatient care. He also stopped taking medication and going to outpatient care two months before the boy's death, something he talks about in interrogation.
Social services in Eslöv have received several reports of concern about the boy, the last time eight months before the boy's death.
Life imprisonment
Lund District Court writes in its judgment that the 40-year-old acted with the intention of killing his son. They believe that he has used such violence on his son, where he should have understood that it endangered his life.
The district court also believes that the act is considered particularly reckless, as the child had no opportunity to protect himself and was committed by his father. The sentence is thus assessed as life imprisonment.
In addition to being convicted of murder, the 40-year-old is also convicted of assault. He is also sentenced to pay damages of several hundreds of thousands of kronor, including to the child's mother.
The lawyer is surprised
"I am surprised that the sentence is so harsh and that the district court's conclusions are so firm," says lawyer Mats Molander, who defended the father.
"The outcome is disappointing for my client, who does not agree with the conclusions. We have not had time to talk, but given his attitude, I assume that we will appeal.
