The Court of First Instance and Instruction number 4 of Vera (Almería) has agreed on Tuesday the lifting of the secrecy of the proceedings opened as a result of the alleged fraud in the postal vote in Mojácar (Almería), in which seven people were arrested last Wednesday, including numbers 2 and 5 of the PSOE candidacy to the City Council.

As recalled in a statement by the Superior Court of Justice of Andalusia (TSJA), this means that the parties in the case may have access to the proceedings conducted so far and not only the Public Prosecutor's Office, as had happened since the beginning of the investigation.

The TSJA has explained that there are already eleven investigated in the case: the seven arrested and three investigated at first, which has been joined by another person who was subsequently arrested, allegedly for similar events but, in this case, for the benefit of the PP.

Of the total investigated, eight were arrested and in that condition were brought to justice while the remaining three are still pending to be summoned by the judicial body.

A separate piece

The eighth detainee is also investigated for the alleged commission of an electoral crime but the investigation opened against him has resulted in the opening of a separate piece within the criminal proceedings initiated since his alleged action would have benefited the PP and not the PSOE, as allegedly would have carried out the rest of those involved.

Although the Court of Instruction also agreed to his provisional release after invoking his right not to testify, nevertheless the judge agreed to his entry into prison in compliance with a requisition issued by a Criminal Court of Almería for facts unrelated to this investigation.

On the other hand, the head of the Court of Vera 4 agreed in previous days the withdrawal of a certain number of postal voting envelopes so that the Police could carry out investigative measures within the case. The votes were deposited in the ballot boxes and only the empty envelopes were collected.

Complaint of the PSOE

The head of the Court of Instruction number 4 of Vera has agreed, on the other hand, to refer to the Deanship of the Courts of this judicial district the complaint filed by the PSOE party against the PP of the town of Mojácar for an alleged case of fraud in the vote.

The complaint will be adjudicated to a Court of Vera in the coming days to continue the investigation.

The Court number 4 of Vera, which is still on duty, has also received a new complaint for another alleged case of fraud in the voting system.

The complaint has been filed by a political party and the judge on duty has instructed the judicial police to initiate the corresponding investigation into these facts.
