The City Council of Torrelodones has refused to qualify as a woman the candidate for local police who presented herself to the physical tests with a notarial act in which she affirmed that she felt woman, under the trans law of the Community of Madrid.

Arcos added that the results of the physical tests have not yet been published, so they still do not know if this candidate has passed the cut as a man.

According to the councilor of Torrelodones, Equality has transmitted to them that this candidate, in his notarial act, pronounced on the law of the Community of Madrid, which the Ministry had no competence to assess.

However, after the approval of the trans-state law last February, it is this that regulates this procedure, an assessment in which the Ministry and the regional executive agree.

Article 44 of this rule requires that the person who wants to carry out this procedure appear in the registry twice, with a maximum of three months between the first and second time to confirm his decision. Subsequently, the Civil Registry will have one more month to issue the resolution.

Therefore, the legal effects that would be granted to this man after the change of the registration mention of sex would still not be applicable, given that since the approval of the trans law on February 28 until the alleged request of the police, the three months required by the norm have not passed.

For its part, sources of the Ministry led by Enrique López have reported that they are only "studying the matter" and it has been the City Council of Torrelodones who has not given valid the change of gender.

The candidate began the selection process for Local Police in January as a male and passed the first personality and psychotechnical test, but in this second physical test he presented the gender change application certificate on the day of the test, so the qualifying court decided to do the tests with two scales, as a man and as a woman, waiting for Equality and the Community of Madrid to transfer guidelines on how to act in this case, which has been given for the first time after the approval of the trans national law.
