Product quality is not only related to the normal and orderly development of the national economy, but also directly related to the life, health and safety of consumers, and more related to social harmony and stability. The recall of defective products is an effective measure to legally ensure product quality, and plays an important role in the market supervision and management of product quality.

The reporter recently learned from the State Administration for Market Regulation that by the end of 2022, China had implemented a total of 690 consumer product recalls, involving 996.6 million products. Especially for automotive products, in 2022, China will implement a total of 204 vehicle recalls, involving 448.8 million vehicles, and electronic appliances and transmission systems are the main defect-producing components.

Standards compliance issues remain a major cause

In early February this year, the Central Committee of the Communist Party of China and the State Council issued the "Outline for Building a Quality Strong Country", which clearly pointed out that it is necessary to "improve the product recall management system and mechanism, strengthen the technical support of recall, and strengthen the recall management of defective products".

The Interim Provisions on the Administration of Consumer Goods Recall, officially implemented on January 2020, 1 and promulgated by the State Administration for Market Regulation, for the first time established a unified consumer product recall management system in China.

On December 2020, 12, the State Administration for Market Regulation issued the Announcement on Strengthening the Supervision of the Recall of Consumer Goods Sold Online, stating that if defects are found in consumer goods sold online, producers should immediately stop producing, selling and importing defective consumer goods, notify other operators to stop operations, and immediately implement the recall in accordance with the requirements of the Interim Provisions on the Administration of Consumer Goods Recall, and must not conceal defects; Where other business operators receive a notice from the producer, they shall immediately stop dealing in defective consumer goods and assist the producer in carrying out the recall. Consumer goods that fail to eliminate defects may not be re-sold.

As a result, from offline to online, China's recall system for consumer goods has been further improved.

According to the relevant person in charge of the State Administration for Market Regulation, in 2022, China will implement a total of 690 recalls of consumer goods, involving 996.6 million products, and defect investigation is still the main way to promote the implementation of recalls by consumer goods enterprises; the recalled products are mainly concentrated in household daily necessities, electronic appliances, children's products and food and other related products; Standards compliance issues remain the leading cause of consumer product recalls.

Automobile products are the "big households" in China's recall system, and they are also the earliest commodities in China to implement the recall system. The Administrative Provisions on the Recall of Defective Automobile Products, which began on October 2004, 10, were jointly formulated and issued by the former General Administration of Quality Supervision, Inspection and Quarantine, the National Development and Reform Commission, the Ministry of Commerce and the General Administration of Customs. With the introduction of the regulations on the recall of defective cars, the recall of food and drugs, the recall of children's toys and the recall of defective consumer goods, the regulations have also been introduced one after another, and a legal system for the recall system of defective products has gradually been formed in China.

According to reports, in 2022, China will implement a total of 204 vehicle recalls, involving 448.8 million vehicles. From the perspective of the composition of defects, electronic appliances and transmission systems were the main defect-producing components, accounting for 67.1% of the total number of recalls. From the perspective of defect clues, in 2022, the State Administration for Market Regulation received 35896,30 reports of automobile defect clues provided by consumers, involving engines (7.23%), electrical equipment (3.18%), body (1.12%), drivetrain (5.<>%), etc.

By the end of 2022, China has implemented a total of 2628,9578 vehicle recalls, involving 7.<> million vehicles.

The recall of new energy vehicles reached a record high

On March 3, the State Administration for Market Regulation issued a circular on "Ten Characteristics of Consumer Complaints and Reports in 14", pointing out that in 2022, the national market supervision department will accept a total of 2022.12315 million consumer complaints, reports and consultations through the national 2940 platform, telephone, fax, window and other channels, an increase of 77.23% year-on-year.

It is worth noting that with the rapid increase in the penetration rate of new energy vehicles, consumers' requirements for quality are also increasing. In 2022, the platform received 1,6 complaints and reports from new energy vehicles, a year-on-year increase of 62.84%. Among them, contract problems, quality problems and false publicity problems increased rapidly, increasing by 126.33%, 77.35% and 75.65% respectively year-on-year. Consumer demands focus on: imperfect after-sales service and non-fulfillment of the "three guarantees" commitment; sudden stalling during driving, oil leakage, abnormal engine noise, brake steering failure, battery module damage; Publishing false information to induce consumers to sign unfair standard terms and reduce the liability of car companies.

According to the relevant person in charge of the State Administration for Market Regulation, in 2022, the State Administration for Market Regulation will improve the recall management mechanism of unified management and hierarchical implementation nationwide, strengthen the guidance and supervision of local consumer goods recall work, and improve the recall work system. Focusing on new energy and intelligent networked vehicles, focus on products related to the key monitoring catalogue of consumer goods recalls, improve defect technical analysis and emergency handling capabilities, increase defect investigation, and highlight the focus of recall work.

It is worth noting that in 2022, a total of 47 new energy vehicle recalls were implemented, involving 121.2 million vehicles, accounting for 27.0% of the total number of recalls for the whole year, a year-on-year increase of 31.5%. The number of new energy vehicle recalls hit a record high. Remote upgrades (OTAs) have gradually become an important way to improve vehicle safety, with 17 OTA recalls involving 88,7 vehicles, accounting for 19.8% of the total number of recalls for the year.

At the same time, SAMR also focuses on innovative safety supervision methods. In the automotive aftermarket stage, in view of the cutting-edge technology of vehicle applications, explore the automotive safety sandbox supervision system, and issue the "Notice on the Trial Implementation of the Automotive Safety Sandbox Supervision System" and the "Notice of the General Office of the State Administration for Market Regulation on Initiating the Pilot Application for the Supervision of the Automotive Safety Sandbox", which fully stimulates the innovation vitality of enterprises under the premise of adhering to the bottom line of safety.

Automotive safety sandbox regulation is a mechanism for in-depth safety testing of cutting-edge technologies in vehicle applications in the post-market stage, with the main purpose of guiding companies to find problems, improve designs, and reduce risks. As a useful supplement to traditional regulatory methods, automotive safety sandbox supervision has changed from passive supervision to active supervision, which is conducive to incorporating quality and safety issues caused by cutting-edge technologies into the scope of supervision earlier, improving emergency handling capabilities, preventing and resolving major risks, protecting the legitimate rights and interests of consumers, and encouraging enterprise technological innovation and advocating best safety design practices.

In addition, in the field of consumer goods, the State Administration for Market Regulation has improved the supervision of the recall of online sales of consumer goods, guided e-commerce platforms to strengthen the safety management of online sales of products, carried out product safety and recall commitments for online platform operating enterprises, improved the product traceability system, strengthened recall information prompts, prevented the continued sale of defective products, and promoted co-governance cooperation in the recall of online sales of consumer goods.
