The man was charged at Helsingborg District Court with assaulting a girl at a party at the end of May last year while she slept.

The district court sentenced the man to two years in prison for rape and decided to expel him from Sweden with a ban on returning here for 10 years. The man would also pay damages to the girl.

But the Court of Appeal has made a different assessment of the evidence and is now acquitting the man.

Although the Court of Appeal considers the girl's information to be credible and reliable, new witnesses have been added to influence the court.

"In light of the information that has come to light, the Court of Appeal has found, on an overall assessment, that it is not beyond a reasonable doubt that the man was guilty of the charged act," the court said in a press release.

The man has consistently denied any wrongdoing.
