The parliamentary group of the Popular Party registered this Wednesday afternoon the request for the appearance of the State Attorney General, Álvaro García Ortiz, before the Justice Commission of the Congress of Deputies for the Miguel Ángel Blanco case.

Sources of the aforementioned parliamentary group explain that they have adopted this initiative as a reaction to the revelations of EL MUNDO where it was reported that the Attorney General's Office had criminally investigated and expedientado for seven months the prosecutor of the National CourtVicente González Mota after he had refused to consider prescribed the case where the former heads of ETA are investigated for the murder of the councilor of Ermua.

Popular sources maintain that "the Attorney General's Office is the most opaque institution of the State" and therefore emphasize that Álvaro García Ortiz must give explanations of what happened in the Lower House.

In the request to appear, registered by the spokesperson Cuca Gamarra, it is maintained that the reason for it is "to report on the exercise of its functions of direction of the Public Prosecutor's Office by virtue of the powers attributed to it by virtue of article 22. Law 50/1981, of 30 December, regulating the Organic Statute of the Public Prosecutor's Office, especially with regard to terrorist offences'. Now, it will be the Bureau of the Congress that qualifies the admissibility of the request presented by the PP.

Revealing secrets

González Mota was criminally investigated by the Prosecutor's Office of the Supreme Court for a crime of revealing secrets and expedientado by the prosecutor promoter of the Disciplinary Action for the alleged leak of an internal email with the chief prosecutor of the National Court, Jesús Alonso, where it was revealed that the current Attorney General of the State had given the instruction to consider prescribed the procedure opened to the former leadership of ETA for the murder of Blanco. However, the department headed by García Ortiz has not been able to prove that González Mota had any connection with the revelation of that internal communication by this newspaper. On the contrary, the decree closing the disciplinary file admitted that only 'mere suspicions or conjectures' weighed against the prosecutor.

On the other hand, the Professional and Independent Association of Prosecutors (APIF), of which this progressive prosecutor is a member, has urged the attorney general to ask for explanations for what happened. "There were no grounds to open criminal proceedings against the prosecutor or to open disciplinary proceedings. (...) But reasons were found to have an excellent prosecutor for months pending a stain on his file, for the only crime of doing his job well when others did it badly, "explains this group in a statement.

From the APIF they emphasize that "seeing the drift and the ways used by the Attorney General's Office and by the Tax Inspectorate" they can only "denounce this type of intimidating practices, which are incompatible with the demands that the Prosecutor's Office must have".

On the other hand, the Board of Prosecutors of the Chamber will meet today and García Ortiz is expected to give an account of the position of the Public Ministry in the Miguel Ángel Blanco case, where it went from assessing the prescription in a hurried way to now point out that the position of the Prosecutor's Office directed by Jesús Alonso will be adopted "at the appropriate procedural moment before the Criminal Chamber of the National Court, once all the evidentiary and documentary material that can contribute to forming a conclusive thesis has been collected". Not in vain has the Court itself left the door open to the fact that the facts have not prescribed.
