• Coalition The castling of Podemos with the yes is yes forces Sánchez to impose himself on Montero for the first time

  • Courts The sexual aggressors benefited by the law of "only yes is yes" already exceed 400

The sentence reductions as a consequence of the “

only yes is yes”

law have already benefited at least 10% of those imprisoned for sexual assault or abuse.

This is clear from the crossing of data between the agreed reviews, which yesterday exceeded 400, and the number of prisoners for crimes against sexual freedom offered by the

Ministry of the Interior

at the end of 2022.

According to these data, there were in

Spain

at the end of 2022 a total of 4,030 imprisoned for these crimes.

Offering the exact percentage is not possible because there are nuances in both figures.

That of prisoners not only includes convictions for sexual abuse and assault of adults and minors, but also adds crimes such as sexual harassment, exhibitionism and prostitution.

Without these assumptions, the proportion of sexual offenders already benefited would rise, but

Penitentiary Institutions

says that it does not have the breakdown by specific category of crime.

As for the already more than 400 sentence reductions, a small part affects cases that were in the appeal phase against an initial sentence and in which the defendant could be on provisional release.

What is certain is that the percentage of benefited prisoners will continue to rise.

Yesterday 11 new cases were known in the

Balearic Islands

, five in

Galicia

and one in

Aragon

(a reduction from 12 to seven years for a rapist who has been released).

Also, not all high courts are centralizing data from their provinces.

And if they do, sometimes the information is transmitted days or weeks late.

The hearings of at least 35 provinces have already reduced sentences

The new milestone of 400 beneficiaries comes coinciding with the negotiations between the

Ministries of Equality

and

Justice

to toughen the law.

Even if an agreement is reached, that will not prevent all the sentences already imposed and the cases in process from continuing to be reviewed.

From the moment the law came into force, those guilty or still suspected guaranteed the right to this review.

The slightly more than 400 reviews have involved at least 35 immediate releases of sex offenders.

Apart from the national figures, some higher courts have offered data that makes it possible to verify what proportion of prisoners has benefited in that territory.

The same 10% national has been reached in

Madrid

, the largest Audiencia in Spain.

He has 447 imprisoned sex offenders under his responsibility.

It has already agreed to 47 sentence reductions, when there are still a hundred matters to be examined.

The figure will continue to rise even if the law of 'yes is yes' hardens

In the Balearic Islands, the proportion is much higher.

Of the 94 cases examined, sentences have been lowered in 39, representing 41%.

Almost along the same lines, in the

Basque Country

, sentences have been lowered in 46 of the 104 cases already examined (44%).

In contrast, relevant Provincial Courts by number of prisoners such as

Barcelona

and

Valencia

have barely released sentence reviews.

But there have been reviews of final convictions in at least 36 provinces and sentences have been lowered in at least 11 high courts.

The Supreme Court has also examined 14 cases and reduced sentences six times.

These decisions of the High Court made the Government see that the massive review that Equality had been denying was unstoppable.
