It has been confirmed that the Democratic Party is promoting a plan to strictly control the announcement of the facts of the suspect while the investigation into Lee Jae-myung, the representative of the Democratic Party, is proceeding in various ways.

It is said that the subject of the ban will be expanded not only to public announcement, but also to distribution and leakage, and to leave the judgment to the court, but there are concerns that it conflicts with the people's right to know.

This is the exclusive report of reporter Han Seong-hee.

Article 126 of the Criminal Act, which stipulates punishment for an employee of an investigative agency if he or she discloses the fact of suspicion before indictment, was evaluated as private because there are few precedents of punishment.

SBS obtained a draft of the bill being prepared by Rep. Kim Seung-won, chairman of the Democratic Party's legal committee, to specify the requirements for the crime of publicizing the facts of the suspect.

However, it is not specified in the bill how to check the distribution and leakage, which are the prerequisites for court claims, but there are concerns that the people's right to know may be violated if indiscriminate claims are made by citing 'unnamed persons'.

[Shim Hyun-jin/Attorney (former police officer): Since (in the court) it is necessary to make a judgment (whether or not to announce the suspect) with limited data, there seems to be a possibility of making a wrong judgment, and (if so) there is a concern that the investigation will be reduced. …

More than 40 lawmakers expressed their intention to participate in the joint initiative of the amendment, and Congressman Kim plans to push for adoption of the party argument.
