In four decades, the
Spanish Constitution
has only been amended twice: in
1992
, which consisted of adding in
article 13.2
the expression "and liabilities" referring to the exercise of the right to vote by foreigners in municipal elections;
and in
2011 , when
article 135
was completely replaced
, which the PSOE and PP agreed to include the principle of budgetary stability.
Now the two big parties, after a year of comings and goings, seem to join hands to undertake a third one that involves the reform of
article 49
and replace the word "handicapped" with "persons with disabilities".
A path that the nationalists want to take advantage of to review the Magna Carta in accordance with their expectations and interests, as reflected in the amendments that have already been registered in Congress to the Bill to reform article 49 of the Spanish Constitution.
The
Official Gazette of the Cortes
published last week all the amendments to the articles.
A
43-page
document in which the claims of some nationalist formations to open the constitutional melon are reflected.
The PNV, for example, wants to change
article 2
of the Magna Carta, which alludes to the "indissoluble unity of the Spanish Nation, common and indivisible homeland of all Spaniards."
A phrase, this one, that the
jeltzale
formation asks to delete from the text, as well as to replace the word nationalities with nations so that it reflects "the right to autonomy of the nations and regions that make up the State."
PSOE and PP have been tug of war for a year with this constitutional reform, to the criticism and discomfort of the sector of people with disabilities.

They have been reluctant due to the fear that the nationalist partners who facilitate governance for Pedro Sánchez will take advantage of the change to open the melon of change in the Magna Carta with issues such as territorial integrity or that they seek to force a referendum to establish a plebiscite on order constitutional, something that would happen if requested by 35 deputies.
In the meeting that the two majority parties held a few days ago in Congress, the Government transferred the commitment to "limit" the constitutional reform to article 49. To do this, this week the government envoys will hold meetings with their partners, to try to convince them not to open a fight against the current constitutional model.
Also to make sure that Unidas Podemos does not support any possible referendum petition.
Hence, despite their conviction to remove the word "diminished" from the Constitution, PSOE and PP have not yet closed the agreement.

Inviolability of the King
What is on the table are the initial intentions.
The PNV also wants to eliminate from
article 8
the reference that the
Armed Forces
have the mission of "defending their territorial integrity and constitutional order", as well as limiting the inviolability of the King.
They propose modifying
article 56
to add that the King is inviolable and is not subject to responsibility "when his acts are related to the institutional functions of the Headquarters of State."
From Junts, for their part, they directly propose that the Constitution collect and protect the right to amnesty.
To this end, they propose a new additional provision that modifies
article 117
so that it reads as follows: "By organic law, the exercise of the right to pardon will be regulated by pardon and amnesty."
"The need for explicit constitutional recognition of amnesty laws is essential to overcome a certain interpretation of the Constitution that blocks even the mere processing of amnesty laws," explain the Catalan separatists.
But there are approaches that start not only from the nationalists.
Unidas Podemos has not proposed any amendment to this constitutional reform.
But last week, in an act of Sumar, Vice President Yolanda Díaz expressed the need to "defend" a reform of
article 135
so that debt payment does not have priority.
"The priority is saving people," she said.
"Article 135, paragraph 3, has to be expelled from our constitutional text."
