Since the 8-year-old was a year old, the custody dispute between the mother and father has been ongoing.

The process started in Sundsvall District Court in 2015 and reached the Court of Appeal in 2022.

When the case was moved to Luleå District Court at the end of 2022, the councilman, who for security reasons wishes to remain anonymous in this text, describes that it was about stopping the Court of Appeal's decision on socializing every other weekend.

That after the father applied for a foreign passport for the son at an embassy.

- I tested the risk of abduction and concluded that there was a fairly large risk.

The legislation requires that the children have good contact with both parents, and a balance must be found between that and the risk of abduction, says the councillor.

A difficult case

The alarm from the police, the school and relatives about the boy's concern for the father came before the Court of Appeal made its decision, which the councilor in Luleå points out.

He also believes that in custody disputes they are partly bound by what the parents themselves present.

- I read through all the documents, but the problem was that the mother and her lawyer only claimed the risk of abduction.

The decision made in Luleå District Court is only a temporary decision pending a new final judgment.

- It's like a kind of band-aid.

A quick decision on little basis to solve an urgent problem, says the councillor.

Was never made contact investigation

Luleå district court also decided that the social service should conduct a major contact investigation.

Despite the fact that the custody dispute has been going on for seven years, none has been carried out because the father objected to the investigation.

Mats Sjösten, lawyer at the Varberg district court, is an expert in custody cases and cannot comment on the specific case, but believes that it is more the rule than the exception that such an investigation is carried out.

- The starting point is that such an investigation must be obtained.

It occurs, according to my experience, in most cases where they are a real dispute between the parents.
