Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom came into force last October and contemplates sentence ranges that, in some cases, may be beneficial for those convicted.

In fact, there have already been reductions in sentences for rapists, with which the Secretary of State for Equality, Ángela Rodríguez, was joking with this week.

In the case of Luis Eduardo Ramírez Icardi, he is pending his appeal before the Supreme Court, in which he demanded the repetition of the trial for which he was convicted in 2019. The High Court now gives him a period of eight days so that he can take refuge, if it deems appropriate, within the framework of the new legislation.

This judicial case has its origin in the abuses that the former Valencian vice president and Equality councilor committed against a minor for whom he was an educator at the center where she lived.

She was under her guardianship and denounced the events in February 2017, although in the center for minors and in the Ministry she was not given credibility at first.

In fact, the file that was opened on this case is the one that has ended the accusation of Oltra and of the technicians and officials who supposedly maneuvered to hide the facts.

The sentence that sentenced Icardi reflects that the abuses occurred between 2016 and 2017 in the room of the minor herself, who "called him because she had difficulties falling asleep due to her fears and asked him to give her a massage," according to the proven facts.

These encounters, which occurred on the night shift, ended with the convict massaging the girl "in the neck and back area and, once he thought she was asleep, he took the girl's hand and masturbated with it, pretending the minor to sleep before the shame that said situation caused him", according to the sentence.

In June 2020, the Valencian Superior Court of Justice annulled the conviction and ordered a repeat hearing so that the court would take into consideration two reports that questioned the credibility of the complainant girl.

After the repetition of the trial, in March 2021 the court's ruling was very similar to the first, but added the aggravating circumstance of prevailing to the continued crime of abuse of a minor under 16 years of age.

The TSJ confirmed the sentence in September 2021, after which Ramírez Icardi appealed to the Supreme Court.

According to the legal sources consulted, although he has not yet formally requested a reduction in his sentence, it could be granted if he does so.
