Five days after the judgment of the criminal court, the public prosecutor Camille Miansoni justified his choice by evoking the "discordance" between two judicial decisions.

Tried before two different jurisdictions, men accused of driving over the body of a 17-year-old young man received very different sentences.

On May 19, 2019, Théo Stéphan was found dead in a parking lot in Landeda, north of Brest (Finistère).

The investigation had shown that the victim had been run over twice by a car.

Four men, including the driver of the vehicle, had been indicted.

First tried by the juvenile court, a minor was sentenced in March 2022 to a one-year suspended prison sentence for failure to assist a person in danger.

On January 5, the Brest criminal court was much more lenient, issuing two acquittals and a six-month suspended sentence for the driver of the car.

The latter had acted under the influence of alcohol and narcotics.

During the hearing, the judge reclassified the facts as "aggravated manslaughter" to retain only driving without a license under the influence of an alcoholic state.

A decision that provoked the anger and incomprehension of the relatives of the victim.

On January 8, a solidarity march brought together more than 1,000 people in the small Breton town.

Public prosecutor Camille Miansoni appealed the decision, as he had done after the verdict of the juvenile court.

“Because of the stakes and the discrepancy between the decision of the juvenile court and that of the criminal court, I considered it appropriate to allow the Court of Appeal to re-examine all the facts and responsibilities in this case," said the magistrate.
