After obtaining a dismissal order concerning the death of her baby three days after his birth on May 18, 2018 at the Montfermeil hospital center (Seine-Saint-Denis), a mother appealed the judgment.

A hearing was held this Thursday before the Paris Court of Appeal, reports

This resident of Chelles (Seine-et-Marne) relies on new reports questioning motherhood.



After strong contractions, Marlène underwent a caesarean nearly an hour and a half after her arrival in the maternity ward, while no cardiac activity was detected in the baby.

The baby died three days later.

The mother wants “the hospital to assume its responsibilities” for the failing management of her retroplacental hematoma (placental abruption).

An “emergency malfunction”

The complainant brought the conclusions of the Regional Health Agency (ARS), and the Conciliation and Compensation Commission for Medical Accidents (CCI).

The latter recognized a "dysfunction of the maternity ward" with "untrained" reception staff, reducing the baby's chances of survival by "90%".

The ARS recognizes, it, failures.

For its part, the Montfermeil hospital believes that the reception protocol has been respected.
