Noting his "direct participation" in the facts and the "premeditated nature" of the violence, the Council of State considered that the sanction pronounced against him was "out of proportion to the faults committed".

It therefore canceled the sanction and referred the case to the disciplinary panel of the National Council for Higher Education and Research.
