The electricity subsidy, which must be paid to people in electricity areas 3 and 4, is based on the household's electricity consumption from October 2021 to September 2022. The person who was on the electricity network agreement on 18 November 2022 will receive the payment.

If you have recently bought a house, you can therefore receive support - which is based on the seller's electricity consumption.

Sellers may be entitled to the money

But according to a clause in many standard contracts for house sales, the seller is entitled to income based on the time before the sale.

This may force the buyer to pass compensation on to the seller.

Varberg broker Martin Birgerson does not think that the government's decision is sufficiently clear as to whether the electricity subsidy should cover past or future costs - which may have a bearing on how the section should be interpreted.

In that criticism, he is supported by several brokers with whom SVT has been in contact.

SVT Nyheter Halland has contacted Energy Minister Ebba Busch (KD), who has not commented on it.

Precedents from HD can decide

Even Erika Björkdahl, professor of civil law with a specialization in real estate law at Uppsala University, agrees that the clause in the purchase contract can give the seller the right to demand back the electricity subsidy.

She sees similarities with a Supreme Court ruling from 1988 where a seller was entitled to compensation from the buyer.
