The PNV has taken advantage of the reform of the Constitution opened since 2019 by the Government of Pedro Sánchez to demand the inclusion of the right to decide for the Basques as a way to achieve independence.

A right to decide that would include an "exercise agreed with the State."

The nationalists include the sovereignist proposals that they have already introduced in the processing of the Basque 'new status' and add the suppression of article 155, used by the Spanish Executive in the face of the Catalan independence challenge in 2017.

PNV and Ciudadanos yesterday registered their amendments to the process of reforming the Constitution that the Government of Pedro Sánchez opened in 2019 and which remained hibernating until last Tuesday.

The Table of Congress put an end to the consecutive extensions for the presentation of amendments that had delayed an attempt to reform article 49 of the Constitution that was limited to

replacing the term "diminished"

included in this constitutional precept.

The PNV did not want to miss the opportunity to register its political demands in Congress to transform the Spanish Constitution with far-reaching changes such as the recognition of the right to decide, a claim shared with pro-independence groups such as EH Bildu and ERC.

The amendment by Aitor Esteban's group proposes to change article 2 of the Constitution and add a new Additional Provision that includes this demand, which is also found in the so-called

new status

, the draft of the Basque statute that has remained frozen in the Autonomous Chamber since January 2020.

The constitutional reform demanded by the nationalists also eliminates the attribution to the

Armed Forces

of "guaranteeing the constitutional order or territorial integrity" and proposes the elimination of article 155.

In addition, to reinforce the "institutional guarantee" that the Constitution already recognizes for Basque regional rights, it is proposed to create a "regional chamber" in the Constitutional Court that would be in charge of resolving jurisdictional conflicts between the Basque Country and the Government of Spain.

In these jurisdictional conflicts, the suspensive capacity of the resources presented by the central government would be eliminated.

Ciudadanos also includes substantial reforms in the Constitution in this unique reform process.
