• Sentence 'El Chicle', sentenced to 14 years in prison for raping his underage sister-in-law

  • Courts The first offense of 'El Chicle' turns against him 17 years later: could he have avoided other dramas?

Practically 13 years, between January 17, 2005 and December 29, 2017. It is the time that

José Enrique Abuín Gey

,

El Chicle

, acted as a sexual predator with impunity without punishment from Justice.

The first date was that of his first rape, his sister-in-law, who was 17 years old at the time.

The second, the day he was arrested as a suspect in the attempted kidnapping and sexual assault of a young woman and the murder of Diana Quer.

Since then, he has not set foot on the street again and probably will not do so again, since he has just received his fourth sentence and a supposed reviewable permanent prison.

This fourth sentence actually refers to the first crime attributed to him.

He is sadly known for the murder of Diana Quer, whom he killed on the night of August 22, 2016, although he was not arrested until 500 days later, he had already committed his first sexual offense years before.

This has just been confirmed by the

Provincial Court of La Coruña

, which found him guilty of that 2005 violation.

The profile of

El Chicle

as a sexual predator was made for the first time by the Civil Guard in 2017 and during the last five years it has been confirmed.

First, he was sentenced to five years in prison for kidnapping and attempting to rape a girl in the town of

Boiro

in A Coruña , just the events that precipitated his arrest on Christmas 2017.

Then, they imposed a reviewable permanent prison on him for killing Diana Quer after forcibly putting her in the trunk of her car with the intention of "sexually attacking" her, undressing her and doing acts of sexual content with her that could not be clarified.

As a third step, he has just lost 14 years for the sexual assault of his sister-in-law.

The prosecutor in the case, for his part, insisted that what

El Chicle

committed with his sister-in-law, who was 17 years old at the time, was a sexual assault with a " book

modus operandi

" in which he sees "preparation, execution and cover-up," according to him, "like the case of Diana Quer."

In all cases, the victims had similar physical characteristics and their way of acting had obvious parallels.

He always seized the victims' mobile and used some dangerous instrument, knife or similar, to threaten them and achieve his purpose.

Only with Quer did he go further and then end his life, to avoid discovery.

Despite these three sexual crimes - the fourth for which he was convicted is for drug trafficking -, he was released during these almost 13 years because the complaint filed at the time by his sister-in-law was filed for practically the entire time.

Thus, the events occurred on January 17, 2005, the young woman,

Vanessa Rodríguez

, then a minor and his wife's twin sister, filed a complaint and was arrested the following day, but eight months later, on August 10, the case was filed by Lack of evidence.

Among other issues, her family did not support her and an expert report did not give credibility to her testimony.

Years later, on March 12, 2018, just over two months after her arrest, and at the request of the Civil Guard, the case was reopened.

Finally, in November she came to trial and both aspects were put on the table.

«Vanessa had no family support and she was forced to live a reality that she did not want.

She recovered her relationship with the aggressor and her sister in a claudication so as not to be separated from her, "two forensic experts pointed out during the oral hearing.

When justice is late, innocent victims always pay

Juan Carlos Quer

The new sentence of the Provincial Court of La Coruña criticizes that expert report of 2005, from the

Forensic Psychology Unit of the University of Santiago de Compostela

and accepts as good a later one carried out by the

Institute of Legal Medicine of Galicia

in 2018 that puts on the "deficiencies and errors" table in the first evaluation.

Those almost 13 years of impunity did not go unnoticed by Diana Quer's father,

Juan Carlos Quer

, who in November attended the last Abuín Gey trial to give his daughter a voice and lamented that when justice "does not arrive, or arrives late and wrong" for the aggressors, "there are always innocent victims who are going to pay the consequences".

This is the case of

El Chicle

, since he considers that if he had been convicted of raping his sister-in-law 17 years ago, his daughter "would not have ended, unfortunately, the way it ended."

One of the controversial aspects of the rape of his sister-in-law was brought to trial by the defense and the defendant himself, who maintained his innocence arguing that his victim denounced him for revenge and, after those acts that he claims he did not commit, he continued to maintain a relationship with the.

At the time of his last word, he assured: "It can be shown that there are people here who have lied just by looking at certain social networks that are open, mine, where there are images of parties, that she (the victim) sends us messages to quote us to her birthday, to her apartment...».

A sister of the victim referred to that family relationship, which continued to exist despite the fact that she denounced him and he was arrested, indicating that "over time, that subject became taboo at home."

It happened to her herself that, at first, "I supported her", but "over the years I had a good relationship with Enrique again."

Both the defendant and his defense tried to make the victim ugly by alleged contradictions and an invented statement.

However, the court concludes that the woman "does not harbor a vengeful will" and continuously maintained the same "coherent" version of the events since 2005, when she already told the facts to a friend and her sister.

According to the sentence, "it is difficult to maintain that a minor under 17 years of age prepared that scenario" in which she recounted what happened for the first time.
