Before a debate in the Assembly on Tuesday (without a vote), the government details its immigration plan.

Expelling more “delinquent foreigners” is one of the main ideas of the text.

Noting that the rate of execution of the "obligations to leave French territory" (OQTF) has never exceeded 20% - it is rather below 10% today - the government is planning a series of hardenings.

The executive first wants to "simplify the litigation of foreigners", which clogs the administrative courts, by going from twelve possible appeals against expulsions to three: "two urgent procedures and one ordinary procedure".

A “structural reform” of the asylum system

The government wants to initiate a "structural reform" at "all stages" of the asylum application with a double objective: to speed up the procedures and to achieve faster deportation.

One of the key measures of the text aims to issue an OQTF to asylum seekers "as soon as the rejection decision is pronounced by the Ofpra", the French Office for the Protection of Refugees and Stateless Persons, without waiting for a possible appeal. .

In the event of a suspensive appeal, the OQTF "will be taken immediately" but its execution "will be postponed to the date of the decision of the National Court of Asylum", specifies the document emanating from the Ministries of the Interior and Work.

New regularizations of undocumented workers?

The executive, which intends to make work "the first place for the integration of foreigners", wants to allow undocumented workers "already in the territory" to obtain a "specific" residence permit when they meet "the needs of occupations in tension”.

This will involve updating the list of these professions, created in 2008 and updated only once in 2021. According to the document, the government wants to include sectors such as catering, early childhood, construction, cleanliness and logistics, environments “which too often resort to clandestine employment”.


Finally, the executive wants to "condition the delivery of the multi-year residence permit to the mastery of a minimum level of French", according to the draft text which takes note that "25% of foreigners" engaged in this learning "n' not reach the level.
