The First Attorney General, Head of the Family and Juvenile Prosecution Office in Dubai, Counselor Muhammad Rustom Bu Abdullah, revealed that the form of marital disputes has changed somewhat in light of the presence of social media platforms, pointing to the large number of insulting cases between spouses through chat programs and the absence of the language of dialogue between the two parties.

He told «Emirates Today» that the culture has changed within the scope of some families because of these influences, while in the past the spouses prevailed over the family’s interest, and were keen on its reputation and keeping children away from problems, and the situation is different now, which requires a degree of awareness of the need not to be affected by the models that present themselves. He confirmed that the family prosecution was able to achieve reconciliation in 31% of the cases during the past year, and 33.5% in 2020, while 40.2% of the cases registered during 2019 were settled.

In detail, Counselor Muhammad Rustom Bu Abdullah said that, based on the cases investigated by the Family and Juvenile Prosecution, social media platforms sometimes negatively affect it in two ways. The Anti-Cybercrime Law, the victim party sues the party involved in the insult, and has in his hands evidence to prove the occurrence of the crime.

As for the second aspect, it is represented in the preoccupation of each of the two parties with the other with these means, until the phone becomes a substitute for the husband or wife even while they are at home, and this in itself causes a kind of estrangement, widens the gap between them, and opens the door to problems and the exchange of accusations.

He explained that the Public Prosecution is doing its utmost to reconcile the two parties, and to contain the problem from its roots, and does not despair of achieving this, until the case is referred to the court, in light of the Public Prosecution’s leadership’s keenness on family stability and strengthening cohesion between spouses in order to preserve the interest of the children.

He pointed out that the psychological and social specialist in the Family and Juvenile Prosecution, sits with each party separately, and discusses the problem in a room designated for reconciliation and prepared in a way that helps calm and tranquility, and if she finds any response, she builds on it to bring the points of view closer and reconciliation between the two parties.

And he added that if the dispute exceeds the social workers and psychologists, the prosecutors continue their efforts, and find a tangible response in several cases, in light of the appreciation they enjoy by members of society.

He stressed that the escalation of the dispute between the spouses causes a rift, and the issuance of a judgment in the case of insult and other cases due to a deep wound, as it is included in the criminal record of the defendants, and leaves a deep psychological impact on the party complained of, pointing out that these dimensions are explained to the spouses, with clarification that the occurrence of Family disagreement is normal and happens between everyone, but there must be some kind of tolerance, especially with family members and relatives in general, because they are the help and support, and good must be rooted among them.

He pointed out that the Family and Juvenile Prosecution Office registered more than 600 cases last year, and the Family and Juvenile Cases Department was able to settle 31% of them without referring them to court. It also recorded 567 cases during the year 2020 in which the index decreased due to the Corona pandemic, and 33.5% of them were settled. While 626 cases were registered during 2019 and reconciliation was achieved in 40.2% of them, with the help of the Family Reconciliation Chamber dedicated to containing these disputes.

Bouabdallah added that the aim of establishing a family reconciliation room is to resolve conflicts between spouses and family members, spread a spirit of tolerance, overcome mistakes and abandon motives for revenge, reconcile between spouses, preserve family cohesion and avoid the phenomenon of divorce, and the consequent displacement and neglect of children. He pointed out that it is a judicial mechanism to save and protect the family from dispersion and loss, in addition to achieving speed in adjudicating cases and cordoning off existing disputes, as one of the parties may review its decisions of its own volition or at the suggestion of the Public Prosecution, and this procedure would consolidate human relations instead of filing a public lawsuit. which may result in the conviction of one of the parties.

Imprisonment and a fine are the punishment for insult

Article 43 of Federal Decree-Law No. 34 of 2021 regarding combating rumors and cybercrime stipulates that whoever insults a third party or attributes an incident to him shall be punished by imprisonment and a fine of not less than 250 thousand dirhams and not more than 500 thousand dirhams, or one of these two penalties. That would make him a subject of punishment or contempt by others, by using an information network, or one of the means of information technology or an information system.

If one of the acts mentioned in the first paragraph of this article is committed against a public servant or one entrusted with a public service on the occasion of or because of the performance of his work, this shall be considered an aggravating circumstance for the crime.
