The Council of Europe Commissioner for Human Rights,

Dunja Mijatovic

, criticized Spain on Tuesday for the management of the massive jump on the

Melilla

fence on June 24, in which at least 23 people died, and insisted that it should not contribute to the human rights violations committed by

Morocco

.

In a statement with the preliminary conclusions of the visit he made last week to Spain, which included a trip to Melilla, Mijatovic charged against the immediate return of

470 migrants

to Morocco "without respecting any legal procedure."

In addition, it considers that what happened that day at the border of the autonomous city shows "the urgent need to improve the measures of responsibility and solidarity between the Member States of the Council of Europe", the body on which this commissioner depends and whose mission is the defense of human rights and the rule of law.

As he had already done on July 1st when he demanded

an in-depth investigation from the Minister of the Interior,

Fernando Grande-Marlaska

, into this attempted massive jump over the fence in which nearly 2,000 migrants participated, Mijatovic sets a framework for what what cooperation with Morocco should be.

"While all states have the right to control their borders and to cooperate with other states to do so, this must be done in full compliance with all international human rights standards," he stressed.

Above all, it insists that, like the other members of the Council of Europe, Spain "should not contribute directly or indirectly to

human rights violations

through measures adopted in its cooperation with third countries."

A way of saying that you cannot delegate to Morocco police actions that violate those basic rights.

But beyond the events of that June 24, the diagnosis of the Council of Europe commissioner, who visited the border perimeter of Melilla, where she met with the Government delegate,

Sabrina Moh

, with the president of the autonomous city,

Eduardo de Castro

, and with high positions in the National Police and the Civil Guard, is particularly severe with the real possibility of requesting asylum there.

His conclusion is that "in practice, there seems to be no other way to enter Melilla and request protection from the authorities other than by swimming or jumping over the fence, risking your life."

For this reason, he asks that this problem be addressed "in a comprehensive manner to ensure that people who need protection can access the territory through legal and safe means."

Mijatovic, who also addressed other issues related to social or sexual rights during his visit to Spain with different authorities, met among others with the Ministers of Inclusion, Social Security and Migration,

José Luis Escrivá

;

Justice,

Pilar Llop

, and Exteriors,

José Manuel Albares

.

He was not received, however, by Grande-Marlaska, who is at the center of the political storm for that massive jump over the fence in Melilla in June.
