Federal Administrative Court: Exit restrictions in Bavaria were disproportionate

The exit restrictions in Bavaria during the first wave of the corona pandemic were disproportionate.

The Federal Administrative Court decided on Tuesday in Leipzig (Az. 3 CN 2.21).

With the judgment, the Third Senate in Leipzig confirmed a decision by the Bavarian Administrative Court from October 2021 and rejected the appeal by the Bavarian state government.

For Saxony, the Third Senate also ruled on Tuesday that the restrictions imposed by the Corona Protection Ordinance in force there were lawful (Az. 3 CN 1.21).

Here, the five federal judges confirmed a judgment by the Saxon Higher Administrative Court from October 2021 and rejected the appeal by the Leipzig lawyer who was suing.

The Saxon ordinance was valid from April 17 to May 3, 2020, that of Bavaria was valid from March 31 to April 19, 2020.

The Third Senate negotiated the revisions almost two weeks ago.
