• Education Justice knocks down Aragonès' attempt to suppress 25% of Spanish this course

The Superior Court of Justice of Catalonia (TSJC) has rejected the appeal of the Generalitat against the judicial decision to apply a minimum of 25% of classes in Spanish in six schools in which it was already taught.

Among them is the Turó del Drac de Canet de Mar, as explained by the Assembly for a Bilingual School of Catalonia (AEB) who added that there are still resources to be resolved, although they will surely follow the same line initiated by the court last week when it rejected the request from the Department of Education to stop applying the 25% and return to the language immersion system in two centers in El Prat and Vila-seca.

In addition to Canet, the other centers in which 25% is held are in Sant Pere de Ribes, Sant Esteve Sesrovires, Cubelles, Tarragona and Els Pallaresos.

Of the thirty schools in which 25% was applied, some 8, according to the AEB, have notified families that they stop doing so following the guidelines of the Generalitat: Turó del Drac school in Canet de Mar, Salvador Dalí institute in El Prat de Llobregat, Valèria Haliné Institute in Castelldefels, Vedruna School in Palamós, Milagros Consarnau School in Hospitalet de Llobregat, Josefina Ibáñez de Abrera School, La Falguera School in Vilanova del Vallés and Vinya del Sastret School in Sant Esteve Sesrovires.

The Generalitat considered that the new law on language use in education, which established Catalan as vehicular and Spanish as learning and which is being appealed before the Constitutional Court, exceeded the percentages established by the TSJC.

That is why they presented appeals on a case-by-case basis, considering the 25% measure unnecessary.

In addition, without waiting for the court ruling, the Department of Education urged all schools in which bilingualism was applied in some of their classrooms, since some family had requested it, to stop doing so.

A score of centers have not paid attention.

With the same arguments as a week ago, the TSJC rejects the appeal of the Generalitat and maintains 25% of Spanish in the classrooms of six schools.

"As has already been indicated, the specific application of the new regulations in each center, in accordance with the new legal criteria, could affect the precautionary measure decreed on the use of languages, but as long as there is no evidence that said application has occurred that affects the precautionary measure, this is not incompatible with the new regulatory framework", indicates the resolution that reminds the Generalitat that "any modification" of the measures must be authorized by the court.

After learning of this decision, the AEB pointed out that "the TSJC reaffirms the obligation to apply 25% of hours in Spanish in 6 new centers" and added that "we are sure that, tomorrow, Mr. Josep González-Cambray will discuss it enthusiastically with the directors to whom he has called 'again' to a meeting 'on the subject'", in reference to the meeting that the Minister and representatives of Education will have with directors of centers in which the 25% is applied to "explain the legal arguments against the resolution' as announced last week.
